Version 1.2.2. Published 29 October 2026 (company details in clause 1.1 updated; no change to fees). In force from 27 October 2026 for sellers who apply on or after that date, and from 10 November 2026 for sellers who accepted an earlier version (from 25 November 2026 for any change to fees), unless they accept this version earlier in the Seller Centre.
1.1 This agreement is between UDITA s.r.o., a company registered in the Czech Republic under company ID (IČO) 19482841, with its registered office at Růženy Svobodové 1818/28, 669 02 Znojmo, Czech Republic, entered in the Commercial Register kept by the Regional Court in Brno, file no. C 134801 (“UDITA”, “we”, “us”, “our”), and the business that applies to open a shop on The Kosher Shop (“you”, the “Seller”).
1.2 We operate The Kosher Shop, an online marketplace on which independent sellers offer goods to customers. We do not sell the goods listed by sellers. Each sale is a contract between you and the customer.
1.3 This agreement applies to shops on the following sites:
(a) thekoshershop.co.uk (the “UK Site”), where prices are in pounds sterling (GBP);
(b) thekoshershop.eu (the “EU Site”), where prices are in euros (EUR); and
(c) thekoshershop.com (the “US Site”), where prices are in US dollars (USD).
Shops on thekoshershop.co.il are governed by a separate agreement in Hebrew. If a seller who has accepted that Hebrew agreement is approved to sell on any of the sites listed above, this agreement applies to those sales.
1.4 This agreement consists of these terms, Schedule 1 (Fees and payouts), Annex 1 (Ranking parameters), Annex 2 (Prohibited and restricted items) and the policies we refer to and publish in the Seller Centre (together, the “Agreement”). If there is a conflict, these terms prevail over the Schedule and Annexes, and the Schedule and Annexes prevail over policies, unless a policy expressly says that it changes a specific clause.
1.5 One Agreement covers all three Sites. Where a clause applies to one Site only, it says so. Clauses marked “UK” apply to sales made on, or shops operated on, the UK Site; clauses marked “EU” apply to the EU Site; and clauses marked “US” apply to the US Site.
1.6 The Agreement is available on the Sites at all times, including before you apply, and you can download and store it. We have written it in plain language. If any part is unclear, please ask us at sellers@thekoshershop.com before you accept.
1.7 You accept the Agreement by ticking the acceptance box when you apply, or by listing goods on a Site, whichever is earlier. The Agreement takes effect when we approve your application and open your shop (the “Shop Opening Date”). Before that date, clauses 4, 19, 20 and 28 apply to your application. When you apply, you also expressly accept, by the same acceptance, clauses 12.5 to 12.8 (reserve, holding payouts, set-off, negative balance), 19.8 (contractual penalty), 24 (indemnity), 25 (limitation of liability and time limit for claims) and 28 (governing law, jurisdiction and Czech law clauses), which are named in the acceptance statement of the application form.
1.8 You confirm that you act for purposes relating to your trade, business, craft or profession, and that the person accepting the Agreement is authorised to bind you. The Agreement is a business-to-business contract. Consumer protection rules that apply to contracts with consumers do not apply between you and us.
2.1 In the Agreement:
(a) “Customer” means any person who buys, or asks to buy, goods from you through a Site, whether a consumer or a business.
(b) “Consumer” means an individual acting wholly or mainly outside their trade, business, craft or profession.
(c) “Completed Order” means an order that has been delivered to the Customer (as shown by tracking or other evidence we reasonably accept) and marked as completed in the Seller Centre, and for which no cancellation, return, claim or dispute is open.
(d) “Customer Data” means personal data about Customers that you receive through the Platform.
(e) “Kashrut Claim” means any statement, symbol, logo, badge, filter selection or other indication, express or implied, that goods are kosher or have a particular kosher status, including “kosher”, “kosher for Passover”, “parev”, “dairy”, “meat”, “chalav Yisrael”, “pas Yisrael”, “yashan”, “glatt”, “mehadrin”, “shatnez free”, or that an item of Judaica (for example a mezuzah scroll, tefillin or sefer Torah) is fit for ritual use.
(f) “Listing” means a product page and all content you supply for it, including titles, descriptions, images, prices, delivery terms and documents.
(g) “Platform” means the Sites, the Seller Centre and the related systems we use to run the marketplace.
(h) “Seller Centre” means the seller dashboard and the related tools we make available to you.
(i) “Sites” means the UK Site, the EU Site and the US Site, and “Site” means any of them.
(j) “Working Day” means a day other than a Saturday, Sunday, public holiday in the country in which you are established, or a Jewish festival day on which work is prohibited, where you have told us in advance that you observe it. For our own obligations, “Working Day” means a day other than a Saturday, Sunday or public holiday in the Czech Republic.
(k) “Your Content” means all material you upload or provide to us, including Listings, logos, photographs, videos, documents and messages.
2.2 Headings are for convenience only. “Including” means “including without limitation”. A reference to a law includes that law as amended or replaced from time to time, and any law made under it.
3.1 We provide an online intermediation service. We host your Listings, show them to Customers, provide checkout, collect payments as your commercial agent (clause 12), and provide tools for orders, messages and returns.
3.2 You are the seller of record for every sale of your goods. You set your prices and delivery charges, decide what to sell, and are solely responsible for the goods, their description and condition, their compliance with law, their delivery, and all after-sales obligations owed to the Customer.
3.3 We identify you as the seller on every Listing, on the checkout page and in order confirmations. You must not present your goods, or allow them to be presented, in a way that suggests that we are the seller or that we supply or guarantee them.
3.4 We are not a kashrut authority. We do not certify, supervise or guarantee that any goods are kosher. When we show a kosher badge or filter, we do so only on the basis of the certificate and information you have provided, which we check for form, validity and coverage before publication. That check does not shift to us any responsibility for your Kashrut Claims.
3.5 We review new Listings before they go live and may carry out further checks at any time. Our reviews and checks are carried out for our own purposes as operator of the Platform. They are not a warranty to you or to anyone that a Listing or product is lawful, safe or accurate, and they do not reduce your responsibilities under the Agreement.
3.6 We may use service providers to operate the Platform, including our hosting provider, our payment service provider (currently Stripe) and the software providers of our marketplace system. You must also comply with any terms of our payment service provider that we notify to you and that apply to you as a seller.
3.7 We do not sell goods on the Sites in our own name, and we do not issue gift cards.
4.1 You may open a shop only if:
(a) you are a business, that is a company, partnership or registered sole trader, and never a private individual;
(b) you are established and registered in a country that is eligible for the Site concerned:
(i) UK Site: the United Kingdom;
(ii) EU Site: a member state of the European Union;
(iii) US Site: the United Kingdom, a member state of the European Union, Israel or the United States;
or you are approved as a cross-border seller under clause 4.6;
(c) you hold every registration, licence, permit and certificate needed to make and sell your goods in the place you operate from and in each country to which you deliver;
(d) you, your owners, directors and controllers are not the subject of sanctions imposed by the United Kingdom, the European Union, the United Nations, the United States or Israel, and are not owned or controlled by a sanctioned person; and
(e) you have not previously had a shop on the Platform terminated by us for breach, unless we agree otherwise in writing.
4.2 Before your shop opens, you must give us the following information and documents, and keep them up to date:
(a) your legal name, trading name, registered address and trading address, telephone number and email address;
(b) a copy of a valid identity document, or electronic identification, of the individual who runs the business and, for a company, of each director and each person who owns or controls more than 25% of it;
(c) the name of your trade or company register and your registration number, or the equivalent means of identification under the law of your country;
(d) your VAT number (or a statement that you are not registered, with the reason) and your tax identification number (for US sellers, your EIN or other taxpayer identification number);
(e) for individuals, date of birth and place of birth where we need it for tax reporting under clause 13.7;
(f) details of the bank account to which payouts will be made, which must be in your name;
(g) your food business registration and the name of the competent authority, where you sell food (US: your FDA food facility registration number where clause 7.4(f) applies);
(h) any licence needed for restricted goods listed in Annex 2 (for example an alcohol premises licence);
(i) for each Kashrut Claim, the certificate required by clause 6;
(j) your product liability insurance certificate where clause 22 requires one;
(k) where required for EU sales, the details of your responsible economic operator in the EU under clause 7.6, and your extended producer responsibility registration numbers under clause 7.10; and
(l) a signed self-certification that you will offer only goods that comply with the law that applies to your sales, including the law of the United Kingdom, of the European Union and its member states and of the United States, as applicable.
4.3 Before we open a shop, we check the application against our quality standards. Our checks may include checks against official registers and databases, sanctions screening, checks with certifying bodies and, where we consider it necessary, a video call or a visit to your premises. You agree to cooperate and to give us any further information we reasonably request.
4.4 We will make reasonable efforts to check that the information in clause 4.2 is reliable and complete, including by using freely accessible official online databases and interfaces. If we have grounds to believe that any information is inaccurate, incomplete or out of date, we will ask you to correct it. If you do not do so promptly, and in any event within the time we set (which will be at least 5 Working Days unless the matter is urgent), we may suspend your shop and payouts until you do.
4.5 We will publish on your shop page and Listings your name, address, telephone number, email address, trade register details and the fact that you have given the self-certification in clause 4.2(l). You consent to this. We will keep the information in clause 4.2 securely for the duration of the Agreement and for 6 months after it ends, and then delete it, unless we must or may keep it longer under law (for example tax, anti-money laundering or accounting rules, or to deal with a claim).
4.6 Cross-border sellers. A seller that is not eligible for a Site under clause 4.1(b) (for example an Israeli seller on the UK Site or the EU Site, a United Kingdom seller on the EU Site, or an EU seller on the UK Site) may sell on that Site only with our prior written approval, which we may give or refuse at our discretion and subject to conditions. We approve cross-border sellers only where we hold the tax registrations needed for the sales concerned under clause 13 or where no such registration is needed. Unless we agree otherwise in writing, the conditions include that you:
(a) deliver only goods that may lawfully be imported into the country of delivery, and give us evidence of this on request;
(b) deliver on a delivered duty paid basis, so that the Customer pays no import VAT, customs duty, handling charge or courier fee on delivery, unless we have agreed a different method that is clearly disclosed to the Customer before purchase;
(c) accept that we may collect and account for VAT, sales tax and customs charges on your sales under clause 13, and deduct those amounts from your payouts;
(d) appoint, and name on your Listings, an economic operator established in the European Union for non-food products sold on the EU Site (clause 7.6), and a United Kingdom based responsible person or importer where UK law requires one;
(e) for food, use an importer established in the country of delivery or otherwise meet the import and labelling rules in clause 7.4, including official controls and health certificates where they apply (products of animal origin from outside the United Kingdom and the European Union may not be sent across borders at all: Annex 2, Part A, item 19);
(f) state the correct country or territory of origin of each product as required by the law of the country of delivery, including the rules on origin labelling of foodstuffs as interpreted by the courts of that country, and claim preferential origin under a trade agreement only where you hold the required proof of origin; and
(g) provide any guarantee, security deposit or additional reserve we reasonably require to cover tax, duty and refund exposure.
4.7 We may refuse an application, or limit the categories or Sites you may sell in, at our discretion. If we refuse an application, we will tell you so and, unless law prevents it, give a short explanation.
4.8 You must notify us within 5 Working Days of any change to the information in clause 4.2, and immediately (and in any event within 24 hours) of the suspension, withdrawal or expiry of any certificate, licence or registration on which your Listings depend.
4.9 US: INFORM Consumers Act. If you sell on the US Site and you are a “high-volume third party seller” within the meaning of the US INFORM Consumers Act (in summary, 200 or more new product sales to US Customers and $5,000 or more in gross revenue from those sales in any continuous 12-month period during the previous 24 months), you must:
(a) give us, within 10 days of our request, your bank account information, contact information (a working email address and telephone number) and tax identification number, and for a business, the name of a responsible individual and a copy of a government-issued identification;
(b) let us verify that information, and certify at least once a year through the Seller Centre that it is accurate and complete, and tell us of any change within 10 days;
(c) if your gross annual revenue from sales through the US Site is $20,000 or more, allow us to disclose to Customers on your Listings and shop page your full name, physical address and contact information, as the Act requires, subject to the limited exceptions the Act allows; and
(d) accept that if you do not provide, verify or certify the information within 10 days of our request, we will suspend your sales on the US Site until you do.
Customers can report suspicious activity on the US Site through the “Report suspicious activity” link shown on each Listing.
5.1 Each new Listing, and each material change to a Listing, is reviewed by us before it goes live. We may refuse a Listing or ask you to change it. We aim to review Listings within 3 Working Days.
5.2 Each Listing must be accurate, complete, not misleading and in English (and for the EU Site, also in any other language required by clause 7.4(e) or by the law of a country to which you deliver). It must include at least:
(a) your identity as seller (which we add automatically from your shop details);
(b) the main characteristics of the goods, including materials, dimensions, weight or volume, and for food the information in clause 7.4;
(c) clear photographs of the actual product, which must not mislead about size, quantity or quality;
(d) the total price including VAT (UK and EU) and all other unavoidable charges, and separately the delivery charges for each destination you serve;
(e) the countries you deliver to and the dispatch and delivery times;
(f) any exception to the right to cancel under clause 8.6, and who pays return costs;
(g) the product safety information required by clause 7.5;
(h) the name, postal and electronic address of the manufacturer and, where clause 7.6 applies, of the responsible economic operator;
(i) any Kashrut Claim and the certifying authority, in the fields provided for that purpose; and
(j) any other information required by law for that type of product, including any warning required on the US Site under clause 7.12.
5.3 We design the Platform so that you can provide the information that law requires for your Listings, including trader details, product identification, safety information and labelling. You must use the fields we provide for this purpose and must not leave a mandatory field empty or enter information that is incorrect or placeholder text.
5.4 Prices. You set your own prices. Prices must be shown in the currency of the Site (GBP on the UK Site, EUR on the EU Site, USD on the US Site). You must not:
(a) show a price that does not include every mandatory charge (other than delivery charges shown in accordance with clause 5.2(d), and on the US Site sales tax calculated at checkout), or add charges after the Customer has committed to buy;
(b) announce a price reduction unless the reference price is a genuine price that you charged for a meaningful period before the reduction; on the EU Site, the reference price must be the lowest price you applied to that product in the 30 days before the reduction;
(c) use false urgency, false scarcity, fake countdown timers, or claims about stock or demand that are untrue; or
(d) use unit pricing that is incorrect, where unit pricing is required.
5.5 Environmental, origin and ethical claims. You must not make environmental, sustainability, health, origin or ethical claims unless they are specific, accurate and supported by evidence you can produce on request. In particular:
(a) UK: you must follow the Competition and Markets Authority’s Green Claims Code;
(b) EU: from 27 September 2026 you must not use generic environmental claims (such as “eco-friendly” or “green”) or sustainability labels that are not based on a certification scheme or established by public authorities, unless the law expressly allows it; and
(c) US: you must follow the Federal Trade Commission’s Green Guides, and you may describe a product as “Made in USA” or similar only where it meets the Federal Trade Commission’s Made in USA Labeling Rule.
5.6 You must keep stock levels in the Seller Centre accurate and must remove or mark as unavailable any product you cannot supply. You must use the holiday mode when you cannot fulfil orders for more than 3 Working Days.
5.7 You must not list the same product more than once to gain visibility, use misleading keywords, use other brands’ or certifying authorities’ names in keywords or titles unless they truly describe the product, or include links, contact details or references to other sales channels in any Listing (see clause 19.6).
5.8 You must not sell goods listed as prohibited in Annex 2. You may sell goods listed as restricted only if you meet the conditions set out there and we have approved the category for your shop.
5.9 Wholesale and quotations. Where we enable wholesale pricing or requests for quotation for your shop, the same rules apply to wholesale Listings. A quotation you give through the Platform is valid for 14 days unless it states otherwise, and an order accepted on the basis of a quotation is subject to the Agreement and to the fees in Schedule 1. Where the Customer is a business, the consumer rights in clause 8 do not apply as a matter of law, but you must still honour what you have promised in your Listing and quotation.
5.10 We may edit the presentation of your Listings (for example the format, category, translation or image size) without changing their meaning, and we may correct obvious errors after telling you.
5.11 Gift cards for your shop. You may offer a gift card for your own shop, as a Listing in the gift card category, if:
(a) it can be used only to buy your goods on the Site concerned, and is redeemed through a code issued through the Platform, never outside it;
(b) its value, how to use it and its validity are stated in the Listing before purchase, and it is valid for at least 12 months from purchase (on the US Site, at least 5 years, or longer where the law of the Customer’s state requires, and with no expiry where state law prohibits it), and in every case for any longer period the law requires;
(c) you, as issuer, honour it, keep a record of balances, comply with all law on gift cards and vouchers that applies to you and to the Customer, and give the Customer a 14-day right to cancel an unused gift card;
(d) if your shop closes or the Agreement ends while a gift card still has a balance, you refund the unused balance to the Customer, and you authorise us to make that refund on your behalf from any amount we hold for you; and
(e) you do not make it exchangeable for cash, except where the law requires.
Our fees apply when the gift card is sold. The part of a later order that is paid with the gift card does not attract a second commission. You are responsible for any tax on the gift card under the rules for single-purpose vouchers or their equivalent.
6.1 All food and drink offered on the Platform must carry a Kashrut Claim supported by a valid certificate. We do not accept food or drink without kosher certification. You may make a Kashrut Claim only if:
(a) the goods are covered by a valid certificate or letter of supervision issued by a recognised kashrut authority, which identifies the product (or product range), the producer and production site, the kosher status (including meat, dairy or parev, and where claimed, kosher for Passover, chalav Yisrael, pas Yisrael or other standards), and the period of validity;
(b) you have uploaded that certificate to the Seller Centre before the Listing goes live;
(c) the Kashrut Claim in the Listing matches the certificate exactly and is no broader than it;
(d) you use a certifying authority’s name, symbol or logo only where you are permitted to do so, and in the form the authority requires; and
(e) for ritual items of Judaica, you hold the evidence described in Annex 2, Part C (for example, for a handwritten scroll, the identity of the scribe and a recent check (bedikah) by a qualified examiner).
6.2 We may publish a list of kashrut authorities that we accept. We may decline a certificate from an authority that is not on the list, or ask for further evidence, at our discretion. Acceptance of a certificate is not an endorsement of the authority or the product.
6.3 You must handle, store, pack and deliver kosher goods in a way that does not affect their status, including keeping original seals and packaging intact where the certificate depends on them, and not repacking or relabelling goods unless your certificate covers that activity.
6.4 You must notify us immediately, and in any event within 24 hours, if a certificate is withdrawn, suspended, expires or changes in scope, or if you become aware of any doubt about the kosher status of goods you have sold. Listings relying on an expired or withdrawn certificate will be hidden automatically or by us. You must stop selling the goods as kosher and, where we or the authority consider it necessary, contact the Customers who bought them and offer a refund.
6.5 Incorrect Kashrut Claims are a serious breach of the Agreement. In addition to our other rights, we may suspend the Listings or your shop without prior warning (clause 17.3).
7.1 You must comply with all laws that apply to your business, your goods and your sales through the Platform, in each country from which you sell and to which you deliver. This clause 7 lists the main areas, but it does not limit your general obligation. You are responsible for obtaining your own legal and tax advice.
7.2 Consumer law. You must give Consumers all rights they have by law, and provide all information required before and after the contract, including under:
(a) UK: the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Digital Markets, Competition and Consumers Act 2024 (including the rules on unfair commercial practices, drip pricing and fake reviews), and the Price Marking Order 2004;
(b) EU: the Consumer Rights Directive 2011/83/EU (including the withdrawal function that applies from 19 June 2026), the Sale of Goods Directive (EU) 2019/771, the Unfair Commercial Practices Directive 2005/29/EC, the Price Indication Directive 98/6/EC, and the national laws that implement them in the country of the Consumer; and
(c) US: the Federal Trade Commission Act, the FTC Mail, Internet, or Telephone Order Merchandise Rule (16 CFR Part 435, including shipping within the time stated or within 30 days and offering a refund if you cannot), the Magnuson-Moss Warranty Act where you give a written warranty, and the consumer protection laws of each state to which you deliver.
7.3 Product safety. You must place on the market only safe products, and comply with:
(a) UK: the General Product Safety Regulations 2005, sector rules (for example on toys, cosmetics, electrical goods and candles), and any rules made under the Product Regulation and Metrology Act 2025 as they come into force, and, for goods delivered to Northern Ireland, Regulation (EU) 2023/988;
(b) EU: the General Product Safety Regulation (EU) 2023/988, Regulation (EU) 2019/1020 on market surveillance and sector rules; and
(c) US: the Consumer Product Safety Act and the Consumer Product Safety Improvement Act (CPSIA), including third-party testing and a Children’s Product Certificate for children’s products, tracking labels, lead and phthalate limits, and the duty to report to the Consumer Product Safety Commission where the law requires it.
7.4 Food. If you sell food or drink, you must:
(a) be registered as a food business with the competent authority (in the UK, with your local authority at least 28 days before you start trading), and comply with food hygiene law, including temperature control during storage and delivery;
(b) EU and UK: label your food in accordance with Regulation (EU) No 1169/2011 on food information to consumers (EU), and the retained version of that regulation and the Food Information Regulations 2014 and equivalent rules in Scotland, Wales and Northern Ireland (UK), and for Northern Ireland Regulation (EU) No 1169/2011, including the 14 allergens, the prepacked for direct sale rules where they apply, and nutrition, quantity, date marking, storage and origin information;
(c) make the mandatory food information (other than the date mark) available in the Listing before purchase, highlight allergens, and ensure that all mandatory information is available on or with the goods at delivery;
(d) use only health, nutrition and other claims that are permitted by law;
(e) for sales to other countries, comply with the labelling language and other requirements of the country of delivery, or deliver only to countries whose requirements you meet. We may restrict delivery destinations for food Listings; and
(f) US: for food sold on the US Site, comply with the Federal Food, Drug, and Cosmetic Act and the rules of the Food and Drug Administration (FDA), including: registration of any facility that manufactures, processes, packs or holds the food (unless an exemption applies); prior notice to the FDA for every shipment of food imported into the United States; English language labelling with the statement of identity, net quantity, ingredients, nutrition facts where required, and name and place of business; and declaration of the nine major food allergens (milk, eggs, fish, crustacean shellfish, tree nuts, peanuts, wheat, soybeans and sesame) as required by the Food Allergen Labeling and Consumer Protection Act and the FASTER Act.
7.5 Product safety information. Each Listing must show any warnings and safety information required by law, in the language of the country of delivery, and any information needed to identify the product (such as type, batch or serial number, and a picture).
7.6 EU responsible person. For non-food products sold to Consumers in the EU, there must be an economic operator established in the EU who is responsible for the product under Article 16 of Regulation (EU) 2023/988 and Article 4 of Regulation (EU) 2019/1020 (a manufacturer, importer, authorised representative or fulfilment service provider). If you are established in the EU and you make or import the product, this may be you. If you are not established in the EU (including if you are established in the UK), you must appoint one before selling non-food products on the EU Site, and show their name and contact details in the Listing and on the product or its packaging. UK: where UK law requires a UK based responsible person or importer for a product (for example cosmetics, toys or electrical goods), you must appoint one before selling it on the UK Site.
7.7 Recalls and incidents. You must monitor your products, keep records needed to trace them, and act at once if you learn that a product may be unsafe, unfit for human consumption, incorrectly labelled (including allergens) or not kosher as claimed. You must notify the competent authorities where required (including through the EU Safety Business Gateway, the UK Office for Product Safety and Standards or the Food Standards Agency, and in the US the Consumer Product Safety Commission or the FDA), notify us within 24 hours, carry out any recall, withdrawal or corrective action, and bear all costs. We may contact Customers directly, publish recall notices, suspend Listings and take any other step we consider necessary.
7.8 Alcohol and age-restricted goods. Alcohol may not be sold on the US Site. On the UK Site and the EU Site you may sell alcohol and other age-restricted goods only as set out in Annex 2, Part B. In particular, you must hold all licences required (in the UK, a premises licence authorising sales for consumption off the premises), sell only duty-paid goods, apply minimum unit pricing where it applies (for example in Scotland and Wales), verify age at the point of sale and on delivery, and on the EU Site comply with the excise rules for distance sales of excise goods (Directive (EU) 2020/262), including payment of excise duty in the member state of delivery.
7.9 Bladed articles. Knives (including challah knives and shechita knives) and other bladed articles may be sold only in compliance with the law of the country of delivery, including in the UK the Criminal Justice Act 1988 and the Offensive Weapons Act 2019 (age verification at sale and delivery, and delivery only to a person aged 18 or over), and in the US the law of the state of delivery.
7.10 Packaging and producer responsibility. You are responsible for any extended producer responsibility obligations for packaging, electrical equipment, batteries, textiles or other goods in each country to which you deliver, including registration with the German packaging register (LUCID), French producer identification numbers and UK packaging producer obligations where they apply to you. You must give us your registration numbers on request. We may block delivery to a country if we are required to check registration and you have not provided it.
7.11 Sanctions, export and import controls. You must comply with all sanctions, export and import control laws, and must not sell or deliver goods to, from or for the benefit of a sanctioned person or territory.
7.12 US: California Proposition 65. If a product you sell on the US Site may be delivered to California and exposes users to a chemical listed under California’s Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65) above the safe harbour level, you must give the clear and reasonable warning the law requires, both in the Listing and on the product or its packaging, and you must tell us so that we can display it. You are responsible for any notice of violation relating to your products.
7.13 Intellectual property. You must not list goods, or use content, that infringe the intellectual property or other rights of any person, including trade marks of certifying authorities, copyright in texts, prayer books, designs and photographs, and designs of Judaica.
8.1 When a Customer places an order for your goods, the order is an offer to buy. A contract of sale is formed between you and the Customer when the order is accepted, which happens when we send a confirmation of acceptance or dispatch on your behalf or when you dispatch the goods, whichever is earlier, on the terms of your Listing and of the customer terms published on the Site concerned, which form part of every sale you make through it. The contract of sale is governed by the law stated in those customer terms. You must accept or decline each order within 2 Working Days. You must accept and fulfil every order placed for goods shown as available, unless the Listing contains an obvious pricing error or you cannot lawfully supply the goods, in which case you must cancel promptly and the Customer will be refunded in full. If you do not accept or decline within 2 Working Days, we may cancel the order on your behalf and refund the Customer.
8.2 You must dispatch each order within the dispatch time shown in the Listing, use a delivery method with tracking for orders above the value we set in the Seller Centre, enter tracking details in the Seller Centre, and pack goods so that they arrive safe, intact and (for food) at the right temperature and within date.
8.2A Packing photo. Before every shipment, you must upload to the order in the Seller Centre at least one clear photo of the parcel, packed and sealed, with the delivery label attached. Each shipment needs its own photo. The Seller Centre will not let you add a shipment, or mark an order as completed, until the photo is uploaded. You must pack in line with the packing standard we publish in the Seller Academy. We may show the photo to the Customer on the order page, and use it when we review a claim about damage, missing items or packing. A missing or misleading packing photo counts against you when we decide a claim under clause 8.9.
8.3 The risk of loss and damage remains with you until the goods are delivered to the Customer. You bear the cost of goods lost or damaged in transit.
8.4 Delivery and damage claims. Customers are asked to report non-delivery, damage or incorrect items within 14 days of delivery (or of the latest expected delivery date). This request does not limit any statutory right of a Consumer, and you must deal with any valid claim made later in accordance with law.
8.5 Right to cancel. Consumers on the UK Site and the EU Site have a right to cancel within 14 days after delivery, without giving a reason, under the UK Consumer Contracts Regulations 2013 and the EU Consumer Rights Directive. Consumers on the US Site have the same 14-day right to cancel under our customer terms. You must:
(a) accept cancellations and refund the price and the standard delivery charge: on the UK Site and the US Site, within 14 days after receiving the goods back or evidence that they have been sent back, whichever is earlier; on the EU Site, within 14 days after the Customer tells you or us of the cancellation, although you may withhold the refund until you have received the goods back or evidence that they have been sent back, whichever is earlier; and in every case within any shorter time the law of the Customer’s country requires;
(b) bear the cost of return unless your Listing clearly states, before purchase, that the Customer pays; and
(c) refund through the Platform, using the same means of payment as the Customer used.
8.6 The right to cancel does not apply where the law excludes it, including for goods that are liable to deteriorate or expire rapidly, goods made to the Customer’s specifications or clearly personalised, sealed goods unsealed after delivery that are not suitable for return for health protection or hygiene reasons, and sealed audio, video or software unsealed after delivery. You may rely on an exception only if the Listing states it clearly before purchase. A kashrut seal is not a hygiene seal: you may not refuse a return only because a kashrut seal has been opened, unless another exception applies.
8.7 Faulty or misdescribed goods. You must provide the remedies required by law for goods that are faulty, not as described or not fit for purpose, including:
(a) UK: the short-term right to reject within 30 days, repair or replacement, and price reduction or final right to reject, under the Consumer Rights Act 2015;
(b) EU: the legal guarantee of conformity of at least 2 years (or longer where national law provides), under Directive (EU) 2019/771. Because sales on the EU Site are governed by Czech law, you must also confirm each Consumer claim in writing, and decide and remedy it within 30 days of the claim unless the Consumer agrees a longer period, as required by §2172 to §2174a of the Czech Civil Code, without prejudice to any more favourable law of the Consumer’s country; and
(c) US: the implied warranties that apply under the law of the Customer’s state, which you must not disclaim where you give a written warranty or where state law prohibits it, and a refund or replacement for goods that are faulty or not as described.
8.8 Customer service. You must reply to Customer messages within 2 Working Days. If you have not replied within 3 Working Days, or if a Customer asks us to intervene, we may step in.
8.9 Our decisions on claims. Where we step in, or where a Customer raises a claim, complaint or chargeback, we may review the evidence from both sides and decide, acting reasonably and in line with the Customer’s legal rights and our customer terms, whether the Customer should receive a full or partial refund, replacement or other remedy. You authorise us to make that decision on your behalf and to issue that refund from the funds we hold for you or to recover it under clause 12. We will give you a reasonable opportunity to respond before we decide, unless the matter is urgent. Our decision does not prevent you from pursuing your own rights against the Customer, but you must not do so in a way that is abusive or that breaches clause 19.
8.10 Guarantees. If you offer a commercial guarantee or warranty, you must state its terms clearly and honour it. It must not suggest that it replaces or limits the Customer’s legal rights.
9.1 All communications with Customers about orders, Listings and enquiries must take place through the messaging system in the Seller Centre, except where you need to contact the Customer by another means to complete delivery (for example, through a courier), or where a Customer contacts you directly and asks to be called back about an existing order. In those cases you must keep a note in the Seller Centre of what was agreed.
9.2 You must be polite and professional, and must not send Customers marketing messages, requests for reviews outside our review process, or any material that is offensive, discriminatory or unlawful.
9.3 We may read and keep messages sent through the Platform for the purposes of resolving disputes, preventing fraud and misuse, enforcing the Agreement and complying with law. We may filter or block messages that contain contact details, payment links or prohibited content.
9.4 We will send notices to you under the Agreement by email to the address registered in your shop and through the Seller Centre. You must send notices to us at sellers@thekoshershop.com.
10.1 Customers may leave reviews of your goods and your shop. We publish reviews in accordance with our published reviews policy, which explains how we check that reviews come from Customers who have bought through the Platform, how ratings are calculated (a simple average of all published reviews) and when we remove reviews.
10.2 You must not, and must not ask or allow anyone else to:
(a) write, commission or publish a fake review, or a review of your own goods or shop, or a review of a competitor;
(b) offer any payment, discount, gift or other incentive in exchange for a review, or for a positive review, or for changing or removing a review, unless we have approved the scheme and the incentive is clearly disclosed in the review;
(c) suppress, hide or pressure Customers to remove negative reviews, or threaten Customers about reviews; or
(d) misrepresent reviews, ratings or endorsements in Listings or elsewhere.
10.3 These practices are banned under the UK Digital Markets, Competition and Consumers Act 2024, under EU consumer law and, for the US Site, under the Federal Trade Commission’s Rule on the Use of Consumer Reviews and Testimonials (16 CFR Part 465). We may remove any review that we reasonably believe breaches this clause or our policy, and treat a breach of clause 10.2 as a ground for suspension or termination. You must indemnify us under clause 24 for any penalty imposed on us because of your breach of this clause.
10.4 You may reply publicly to a review once, in a factual and courteous manner. You may report a review that you believe breaches our policy.
11.1 You must pay the fees set out in Schedule 1: a commission on each item sold, a fixed fee per order and the payment processing fee at cost. There is no subscription, no shop opening fee and no listing fee.
11.2 Fees are calculated automatically on each order and deducted from the amount we collect for you. We will issue a monthly invoice or statement for the fees in the Seller Centre.
11.3 Fees are stated exclusive of VAT and similar taxes. Where we are required to charge VAT on our fees (for example to sellers established in the Czech Republic), we add it at the applicable rate. Otherwise, you account for any VAT or similar tax on our fees under the reverse charge or the rules of your country.
11.4 Our commission and fee per order do not include the cost of processing the Customer’s payment. The payment processing fee for your orders is charged to you at cost, without any mark-up, as set out in Schedule 1. Our fees and the payment processing fee are not refunded when an order is cancelled, refunded or charged back after it was paid, whether in whole or in part, except that where the cancellation or refund was caused by our own error or by a fault of the Platform, we credit our fees on that order back to you. Chargeback fees and any penalty that our payment service provider charges us in relation to your order are charged to you at cost, unless the chargeback was caused by our own error.
11.5 Paid promotion. You may choose to promote individual products on a Site for a fixed fee, as set out in paragraph 3A of Schedule 1. Promotion is optional, is bought one product at a time from the Seller Centre, and never affects how we treat your shop in any other way. Our commission does not change whether or not you promote.
11.6 We may change our fees by giving you at least 30 days’ notice under clause 26. The change applies only to orders placed after the change takes effect, and does not end a launch rate already applied to your shop.
12.1 Commercial agency for sales and payment. You appoint us as your commercial agent, acting only on your behalf and never on behalf of the Customer, with authority to negotiate and conclude sales of your goods with Customers through the Platform in your name. This includes authority to accept orders and send order confirmations on your behalf, to agree cancellations, to decide claims under clause 8.9, to agree refunds, and to receive payments from Customers for your goods through our payment service provider. Payment by the Customer to us, or to our payment service provider, discharges the Customer’s obligation to pay you, whether or not we have yet paid that amount to you. We do not act for Customers in receiving payment.
12.1B Stripe Connect. We use Stripe Connect so that the money from your sales is held and paid out by our payment service provider, Stripe, and not by us. To sell, you must open a connected Stripe account through our onboarding and accept Stripe’s Connected Account Agreement, which forms part of your relationship with Stripe. You authorise us to instruct Stripe to deduct our fees, the payment processing fee, refunds, chargebacks and any other amounts due to us under the Agreement before Stripe pays out to you, and to hold back amounts under clauses 12.5 and 12.6. Stripe pays out to the bank account in your name that you register with Stripe, on the schedule in Schedule 1. Until your shop is connected to Stripe Connect, or where Stripe Connect is not available for your country, clause 12.4 applies instead.
12.1A The agency is non-exclusive. We may act at the same time for any number of other sellers, including your competitors, and we are not obliged to promote your goods in preference to others. Our remuneration for the agency is the fees in Schedule 1. To the extent permitted by law, the parties exclude any provision of the law on commercial agency that is inconsistent with the Agreement, including any right to an indemnity or compensation on termination.
12.2 Your balance. Your balance is the amount collected for your goods and delivery charges, less our fees, any refunds, chargebacks, VAT, sales tax or duties under clause 13, and any other amounts due to us under the Agreement. No interest is payable on any balance.
12.3 Clearance. Amounts for an order become available for payout when the order is a Completed Order and the clearance period in Schedule 1 has ended.
12.4 Withdrawal without Stripe Connect. Where clause 12.1B does not apply, you may request a payout of your available balance at any time through the “Withdraw” function, subject to the minimum amount in Schedule 1. We will make payment by bank transfer to your registered account, normally within 5 Working Days of your request. We do not charge a transfer fee. You bear any charges made by your own bank and any currency conversion costs.
12.5 Reserve. We may hold back part of your balance as a reserve to cover expected refunds, returns, chargebacks, claims, VAT, sales tax and duties, and other amounts you may owe. The reserve will be proportionate to the risk, taking into account your order history, your category (for example perishable food or high-value items), open claims and any breach. We will tell you if we set or increase a reserve and the reason for it.
12.6 Holding payouts. We may delay or withhold payouts for as long as reasonably necessary if:
(a) we reasonably suspect fraud, money laundering, sanctions breach or other unlawful activity;
(b) your shop is suspended, or a significant number of claims or chargebacks is open;
(c) we are required to do so by law, a court, an authority or our payment service provider;
(d) you have not provided information we need under clauses 4, 13.7 or 4.9; or
(e) the Agreement has ended, in which case we may hold the balance for up to 120 days after the last delivery date, or longer while any claim or chargeback remains open.
12.7 Set-off. We may deduct from any amount we hold or owe to you any amount you owe to us under the Agreement, including fees, refunds, chargebacks, VAT, sales tax and duties, costs under clause 24, and any contractual penalty under clause 19.8. This applies whether or not the amounts are due, fixed or relate to the same Site, to the extent permitted by law.
12.8 Negative balance. If your balance is negative, you must pay the amount due within 14 days of our request. We may charge statutory interest on late payments and recover the amount from later payouts.
12.9 Promotions. Where a Customer uses a promotion that we fund, we treat the amount as paid by the Customer to you. Promotions you fund reduce the price on which our commission is calculated.
12.10 Errors. If we pay you an amount in error, you must repay it on request and we may deduct it from later payouts.
13.1 You are responsible for all taxes on your sales, including VAT, sales tax, customs duty, excise duty and income or corporation tax, for registering where required, for issuing invoices or receipts required by law, and for filing returns. Our invoicing helper is a convenience. It does not transfer any tax obligation to us.
13.2 Deemed supplier rules. Under UK and EU VAT law, an online marketplace may be treated as the supplier of goods for VAT purposes in some cases, in particular:
(a) UK: goods sold by a seller established outside the UK where the goods are in the UK at the point of sale, and goods in consignments of £135 or less imported into the UK and sold to a Consumer; and
(b) EU: goods imported in consignments of an intrinsic value not exceeding €150 and sold to a Consumer, and goods located in the EU sold to a Consumer by a seller not established in the EU.
Sellers established in the EU are not established in the UK, and sellers established in the UK are not established in the EU, for these purposes.
13.3 Where we are, or may be, treated as the supplier under clause 13.2 or any similar rule (a “Deemed Supply”):
(a) we will calculate and account for the VAT due on the sale, and we may deduct that amount from the price collected before crediting your balance;
(b) your prices must still be shown inclusive of VAT, and you must not charge VAT to the Customer separately or issue a VAT invoice to the Customer for that sale;
(c) you must give us all information we need to apply the rules correctly, including the location of the goods at the time of sale, the place of dispatch, the value and tariff classification of each consignment, and your establishment;
(d) you must not split consignments in order to come under a value threshold; and
(e) you must indemnify us under clause 24 for any VAT, duty, interest or penalty arising from incorrect information you give us.
13.4 Customs duties. EU: from 1 July 2026 the EU no longer exempts low-value consignments from customs duty, and further EU rules may treat online marketplaces as the importer of goods sold by non-EU sellers. US: US duty-free treatment of low-value parcels is currently suspended, so duty may apply to any shipment into the United States whatever its value. Unless clause 4.6(b) says otherwise, you must ship to US Customers on a delivered duty paid basis. Where we become liable for, or collect, customs duty, handling fees or similar charges on your sales, we may collect them from the Customer at checkout, deduct them from your balance, or require you to price them into your Listings, and you must provide the data required.
13.5 US: sales tax. Where we are a marketplace facilitator under the law of a US state, we will calculate, collect and remit the sales tax due on your sales delivered to that state, and you must not collect that tax separately. You remain responsible for sales tax in any state where we are not a marketplace facilitator and you have an obligation to collect it.
13.6 If UK, EU or US law changes so that we become liable for VAT, sales tax or other taxes on sales by sellers who are established in the same country as the Customer, clause 13.3 will apply to those sales from the date the law takes effect. We will tell you as early as we reasonably can.
13.7 Reporting to tax authorities. We are required to collect information about sellers and their sales and to report it to tax authorities under Council Directive (EU) 2021/514 (DAC7), as implemented in the Czech Republic, and under any similar rules that apply to us, including the UK Platform Operators (Due Diligence and Reporting Requirements) Regulations 2023 and US information reporting rules where they apply. Tax authorities may share this information with other countries. You must provide the information we request (including tax identification numbers, VAT numbers, date of birth for individuals, address and bank details) within the time we set. If you do not, after two reminders, we may suspend payouts and your shop until you do.
13.8 We may refuse to accept, or may suspend, sales on a Site where you do not give us information we need to comply with tax rules, or where the tax risk is disproportionate.
14.1 Annex 1 describes the main parameters that determine how Listings and shops are ordered in search results, category pages and shop pages, and their relative importance.
14.2 You can pay to improve the position of a specific product only through paid promotion under clause 11.5 and paragraph 3A of Schedule 1. Promoted products are always labelled to Customers as “Sponsored”. No other payment, and not the amount of commission you generate, affects ranking. Annex 1 explains how paid promotion fits into ranking.
14.3 We may feature Listings and shops in editorial collections, newsletters, seasonal guides and on social media. Annex 1 explains how we choose them. You do not have a right to be featured.
14.4 Differentiated treatment. We do not sell goods on the Sites in our own name, and we do not give any seller preferential treatment through ranking, data access or fees, other than the launch rate in Schedule 1, which applies to every shop that meets its conditions, and paid promotion under clause 11.5, which is offered to every seller on the same terms. If this changes, we will describe the differentiated treatment in Annex 1 before it applies.
14.5 We do not offer ancillary goods or services (such as financing or insurance) to Customers in connection with your goods. We do not restrict your ability to offer the same goods to customers through other channels, at different prices or on different terms, apart from the restrictions on diverting Platform Customers in clause 19.6.
15.1 You keep ownership of Your Content. You grant us a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to use, copy, store, adapt (including to crop, resize, translate, format and add our branding), publish and display Your Content and your shop name, trade marks and logo:
(a) to operate the Platform and display your Listings on all our Sites and apps, including thekoshershop.co.il;
(b) to promote the Platform, your shop and your goods, including in search engines, price comparison services, advertising networks, social media, newsletters, printed materials and press; and
(c) to comply with law and enforce the Agreement.
15.2 We may sublicense these rights to our service providers and advertising partners only for the purposes in clause 15.1.
15.3 The licence lasts for the duration of the Agreement and then for 12 months for materials already produced or scheduled, and indefinitely for archival copies, records of past orders, reviews and material held for legal reasons. We do not have to recall material already published or distributed before the Agreement ended.
15.4 You confirm that you own or have the right to license all of Your Content, that its use under this clause will not infringe any rights of others, and that any identifiable person shown in Your Content has given any consent required by law.
15.5 All rights in the Platform, The Kosher Shop name and brand, our designs, software and data (except Your Content) belong to us or our licensors. You may use our name and badges only as described in our brand guidelines and only while the Agreement is in force.
15.6 We operate a procedure for rights holders to report infringements. If we receive a report about your Listing, we will handle it under clause 16. We will terminate the shops of sellers who repeatedly infringe the rights of others.
16.1 Anyone may notify us of content on the Platform that they consider illegal or in breach of the Agreement, using the reporting form on the Sites or by email. We review notices diligently, objectively and without undue delay. We may use automated tools to detect potentially illegal or prohibited content, but decisions to remove Listings or suspend shops are reviewed by a person.
16.2 If we remove, disable or demote a Listing, restrict the visibility of your shop, suspend or terminate your shop, or suspend or restrict payouts, we will send you a statement of reasons at the latest when the measure takes effect, unless law prevents us. The statement will include:
(a) what we have done, its territorial scope and its duration;
(b) the facts and circumstances relied on, including whether the measure followed a notice from a third party (we will identify the notifier only where necessary and lawful);
(c) whether automated means were used;
(d) the clause of the Agreement or the law relied on, with an explanation; and
(e) the redress available to you, including our complaints system, mediation and the courts.
16.3 Where we act under clause 16.2, you will have an opportunity to clarify the facts through our complaints system under clause 27. If we find that the measure was not justified, we will reverse it without undue delay.
16.4 We may suspend, for a reasonable period and after a warning, the processing of notices or complaints from anyone who frequently submits manifestly unfounded notices or complaints, and the shop of any seller who frequently provides manifestly illegal content.
17.1 We may restrict, suspend or remove any Listing, limit your shop’s visibility or functions, or suspend your shop or payouts, in whole or in part, where:
(a) you breach the Agreement, including Annex 2;
(b) a Listing or your goods are, or we reasonably suspect that they are, illegal, unsafe, counterfeit, infringing or incorrectly labelled;
(c) a Kashrut Claim is not supported by a valid certificate, or we have reasonable grounds to doubt it;
(d) a required document, licence or registration has expired or been withdrawn, or you have not provided information required by clauses 4 or 13;
(e) you receive repeated or serious Customer complaints, your dispatch, cancellation, refund or response performance falls materially below the standards we publish in the Seller Centre, or your chargeback rate is excessive;
(f) we reasonably suspect fraud, money laundering, sanctions breach, review manipulation or diversion of Customers or payments;
(g) a court, authority, certifying body or our payment service provider requires or requests it; or
(h) action is needed to protect Customers, other sellers or us from harm or legal liability.
17.2 Restrictions will be proportionate to the reason. Where the problem concerns only some Listings, we will act on those Listings rather than on your whole shop, unless the circumstances justify wider action.
17.3 Where possible, we will give you a warning and a reasonable opportunity to remedy the problem before we act. We do not need to give a warning where the matter concerns food safety, product safety, a Kashrut Claim, fraud, an order of an authority, or a serious or repeated breach.
17.4 We will send a statement of reasons under clause 16.2. A suspension lasts until the reason for it has been resolved, or until we terminate the Agreement under clause 18.
17.5 During a suspension you must continue to fulfil and service existing orders unless we tell you not to, and you remain liable for refunds, claims and chargebacks.
18.1 Termination by you. You may terminate the Agreement at any time by closing your shop in the Seller Centre or by notice to us. Termination takes effect when your open orders, cancellations and returns have been completed, and in any event 30 days after your notice, unless we agree a shorter period.
18.2 Termination by us with notice. We may terminate the Agreement for any reason by giving you at least 30 days’ notice, with a statement of reasons.
18.3 Termination by us without notice. We may terminate the Agreement with immediate effect, with a statement of reasons (except where clause 18.4 applies), where:
(a) we are subject to a legal or regulatory obligation that requires us to terminate in a way that does not allow us to respect the 30-day notice period;
(b) we exercise a right of termination for an imperative reason under applicable law, which includes a material breach of the Agreement that, by its nature, justifies immediate termination (for example selling unsafe or illegal food, knowingly making a false Kashrut Claim, selling counterfeit goods, fraud, or diverting Customers or payments); or
(c) you have repeatedly breached the Agreement.
18.4 We are not required to give a statement of reasons where law prevents us from disclosing the facts, or where we terminate because of repeated breaches that we can demonstrate.
18.5 Wind-down. When the Agreement ends:
(a) your Listings will be removed and new orders will be blocked;
(b) you must fulfil all orders already placed, unless we cancel them, and you must deal with all returns, claims and statutory rights of Customers for orders made before termination;
(c) we may hold your balance under clause 12.6(e), and will pay the remaining balance, less amounts due to us, at the end of that period;
(d) you must stop using our name and badges and, subject to clause 19, delete Customer Data; and
(e) clauses 3.4, 6.4, 7.7, 8, 11.4, 12, 13, 15.3, 19, 20, 21, 23, 24, 25, 27, 28 and 29, and any other clause that by its nature should continue, survive termination.
18.6 Data after termination. For 30 days after termination you may download from the Seller Centre your order history, invoices, payout records and the Customer details needed to complete open orders and meet your legal obligations. After that, you must ask us for any further records, which we will provide where we still hold them and the law permits.
19.1 Access to data. We collect personal and non-personal data when Customers and sellers use the Platform, including Listing data, search and browsing data, order data, reviews, messages and payment records. You have access through the Seller Centre to:
(a) the data you provide;
(b) data about your orders, including the Customer’s name, delivery address, telephone number where needed for delivery, items ordered and messages;
(c) aggregated performance data for your shop, such as views, sales and ratings; and
(d) your reviews and the related order data.
You do not have access to Customers’ payment card details, their data relating to other sellers, or aggregated data about other sellers or the Platform as a whole. We do not share with third parties the data you provide or that is generated by your sales, except with our service providers, payment providers, couriers you choose, tax and other authorities, professional advisers, and as required by law or to enforce the Agreement. Our privacy policy explains how we use personal data.
19.2 Roles. We and you are each an independent controller of Customer Data for your own purposes. We are not your processor and you are not ours. We are not joint controllers. Each of us must comply with the data protection law that applies to it, including the UK GDPR and the Data Protection Act 2018, the EU General Data Protection Regulation (EU) 2016/679, and, for US Customers, applicable state privacy laws.
19.3 Use of Customer Data. You may use Customer Data only to fulfil the order, deal with returns, claims and after-sales service, and comply with your legal obligations (including tax records). You must not:
(a) use Customer Data for marketing or to add Customers to any mailing list, unless the Customer has given separate, freely given consent outside any Platform transaction and the consent was not obtained through the Platform;
(b) sell, share or disclose Customer Data to anyone other than your service providers (such as couriers) who need it for those purposes; or
(c) keep Customer Data longer than necessary for those purposes.
19.4 Security and breaches. You must keep Customer Data secure, using appropriate technical and organisational measures, and notify us without undue delay, and in any event within 48 hours, of any personal data breach affecting Customer Data. You must assist us in responding to data subject requests or regulatory enquiries relating to Customer Data you hold.
19.5 International transfers. If you are established outside the UK and the EU, you may receive Customer Data only if the transfer is lawful, for example under an adequacy decision covering your country (as currently applies to Israel), under the EU-US Data Privacy Framework or the UK extension to it if you are certified under it, or under standard contractual clauses that you sign with us on request. You must tell us at once if the basis for the transfer changes or ends.
19.6 Anti-circumvention. You must not, directly or indirectly:
(a) invite or encourage a Customer who has found you through the Platform to buy from you outside the Platform, including by inserts in parcels, messages, Listings, business cards or social media;
(b) ask a Customer to pay you, or accept payment from a Customer, outside the Platform for an order placed or discussed through the Platform; or
(c) cancel a Platform order in order to complete the sale outside the Platform.
This clause applies to Customers whose first contact with you was through the Platform, for 12 months after that contact. It does not prevent you from dealing with customers who were already your customers before, or who find you independently, or from including in parcels your ordinary business information where required by law (such as your address on an invoice).
19.7 You may include a thank-you note or packaging that shows your brand, provided it does not contain an offer, discount code or call to action for purchases outside the Platform.
19.8 If you breach clause 19.6, you must pay us, as a contractual penalty, an amount equal to twice the fees that would have been payable on the diverted sales if they had been made through the Platform, and in any event at least £250 (UK Site), €250 (EU Site) or $250 (US Site) for each proven instance. The parties agree that, in addition to the penalty, we may claim damages that exceed the penalty, and that the penalty does not affect our right to suspend or terminate.
20.1 Each party must keep confidential any non-public information received from the other in connection with the Agreement, including commercial terms not published on the Sites, technical and security information, and information about Customers, and must use it only for the purposes of the Agreement.
20.2 This does not apply to information that is or becomes public through no fault of the receiving party, that the receiving party already lawfully held, or that must be disclosed by law, a court, an authority, a certifying body or a stock exchange, or to professional advisers and insurers bound by confidentiality.
20.3 This clause continues for 3 years after the Agreement ends, and indefinitely for personal data and trade secrets.
21.1 You must keep, for at least 6 years (or longer if law requires), records that show compliance with the Agreement, including supplier invoices, kashrut certificates and supervision letters, batch records, food safety records, licences, test reports, and records of complaints and recalls.
21.2 We, or an independent person we appoint who is bound by confidentiality, may verify your compliance, including by:
(a) asking you for copies of records, certificates and evidence of the origin and authenticity of your goods, which you must provide within 5 Working Days (or within 24 hours where the request concerns food safety, a Kashrut Claim or a recall);
(b) contacting the issuing kashrut authority, licensing authority, register or supplier to confirm documents you have provided, and you authorise those bodies to answer us;
(c) visiting your premises during normal business hours on at least 5 Working Days’ notice, or on shorter notice if we reasonably suspect a serious breach;
(d) making test purchases, including anonymous purchases; and
(e) having goods examined or tested by a qualified person or laboratory, including for allergens, ingredients, materials or the authenticity of handwritten scrolls.
21.3 We pay the cost of verification, except that you must reimburse the reasonable cost of the verification (including test purchases and testing) if it shows a material breach. For test purchases, ordinary fees apply, and the order is subject to the usual rules on cancellation and refunds, except that we may keep goods that show a breach as evidence.
22.1 If you sell food or drink, alcohol, cosmetics, candles, toys or children’s products, electrical goods, bladed articles, or any other category that we classify as higher risk in the Seller Centre, you must hold product and public liability insurance with a reputable insurer, covering sales into every country to which you deliver, with a limit of indemnity of at least £1,000,000 (UK Site), €1,000,000 (EU Site) or $1,000,000 (US Site) for each claim. Where you sell on more than one Site, the cover must meet the highest of the applicable amounts and cover all the countries concerned.
22.2 For all other categories, we recommend that you hold such insurance and we may require it if your sales, risk profile or claims history justify it.
22.3 You must provide a certificate of insurance before you list the relevant goods and on each renewal, and must tell us at once if the insurance is cancelled or reduced. Insurance does not limit your liability under the Agreement.
23.1 You warrant, on the date you accept the Agreement and on each day it remains in force, that:
(a) all information you have provided to us is true, complete and up to date;
(b) you have full power and authority to enter into and perform the Agreement;
(c) your goods are lawfully made, owned by you or lawfully sourced, safe, and conform to their Listings and to all applicable laws;
(d) every Kashrut Claim is true and covered by a valid certificate as described in clause 6;
(e) your goods and Your Content do not infringe the rights of any person; and
(f) you hold all licences, registrations and insurance required by the Agreement and by law.
24.1 You must indemnify us, our affiliates and our and their directors, employees and agents (the “Indemnified Persons”) against, and pay on demand, all losses, liabilities, damages, fines, penalties, taxes, costs and expenses (including reasonable legal and other professional fees, and the costs of investigating, defending or settling a claim) that any of them suffers or incurs arising out of or in connection with:
(a) your goods, including any claim that they are unsafe, defective, not fit for human consumption, incorrectly labelled, contain undeclared allergens, or caused death, personal injury or damage to property;
(b) any Kashrut Claim, or any claim that goods are not of the kosher status or ritual fitness you represented;
(c) any claim that your goods or Your Content infringe intellectual property or other rights;
(d) your breach of the Agreement or of any law, including consumer, food, product safety, data protection, sanctions, licensing and tax law;
(e) any VAT, sales tax, customs duty, excise duty or other tax, interest or penalty that we are required to pay in relation to your sales, to the extent not deducted from your balance, including where we are a deemed supplier, marketplace facilitator or importer and you have given us incorrect or incomplete information;
(f) any recall, withdrawal, corrective action or Customer notification relating to your goods;
(g) any refund, chargeback, payment reversal or associated fee relating to your orders; and
(h) any act or omission of your employees, subcontractors, couriers or other persons acting for you.
24.2 Conduct of claims. We will notify you of any third-party claim covered by clause 24.1 within a reasonable time (a delay affects your obligation only to the extent that it has prejudiced you). We may choose to conduct the defence ourselves, using counsel of our choice at your cost, or to ask you to conduct the defence at your cost in consultation with us. You must not settle any claim in a way that imposes any obligation on, or admits fault by, an Indemnified Person without our prior written consent. You must cooperate fully and provide the information and documents we request.
24.3 The indemnity does not apply to the extent that the loss was caused by our own breach of the Agreement, negligence or wilful misconduct.
24.4 The Indemnified Persons other than UDITA may rely on and enforce this clause as third-party beneficiaries.
25.1 Nothing in the Agreement limits or excludes our liability for:
(a) death or personal injury caused by our negligence;
(b) fraud or fraudulent misrepresentation;
(c) harm caused intentionally or by gross negligence;
(d) our obligation to pay you your balance properly due under clause 12; or
(e) any other liability that cannot lawfully be limited or excluded.
25.2 Subject to clause 25.1, we are not liable to you, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for:
(a) loss of profit, revenue, business, sales, goodwill, reputation or anticipated savings;
(b) loss or corruption of data (other than as a result of our breach of data protection law);
(c) any indirect or consequential loss; or
(d) any loss caused by the acts or omissions of Customers, other sellers, couriers, kashrut authorities, payment service providers or other third parties not acting on our behalf.
25.3 Subject to clause 25.1, our total liability to you arising out of or in connection with the Agreement in any period of 12 months is limited to the total fees you paid to us in the 12 months before the event giving rise to the claim (or, in the first 12 months, the fees paid up to that event, multiplied up to an annual figure), and in any event will not exceed £10,000 (UK Site), €10,000 (EU Site) or $10,000 (US Site).
25.4 We provide the Platform on an “as available” basis. We will use reasonable care and skill to keep it running, but we do not promise that it will be uninterrupted or error-free, or that your Listings will achieve any level of sales or visibility. We may carry out maintenance and updates, and will try to schedule planned maintenance at times of low traffic.
25.5 Time limit for claims. The limitation period for any claim by either party against the other arising out of or in connection with the Agreement is one year, starting on the day on which the claimant became aware, or ought to have become aware, of the facts giving rise to the claim. This clause does not apply to claims for harm caused intentionally or by gross negligence, to claims for amounts owed to us under clauses 12, 13, 19.8 or 24, or to any claim for which the law does not allow a shorter period.
26.1 We may change the Agreement, including Schedule 1 and the Annexes, by notifying you by email and in the Seller Centre at least 15 days before the change takes effect (30 days for changes to fees). We will give a longer period where the change requires you to make significant technical or commercial adaptations, so that you have a reasonable time to adapt.
26.2 The notice will set out the changes. You may terminate the Agreement before the end of the notice period by closing your shop, and termination will take effect within 15 days of your notice (subject to completing open orders), without any charge for terminating.
26.3 You may waive the notice period by a clear affirmative action, such as submitting a new Listing after receiving the notice, except for changes to fees.
26.4 We may make changes with shorter or no notice where we are required to do so by law or by an authority, in a way that does not allow us to give 15 days’ notice, or where we need to address an unforeseen and imminent danger to Customers or to the Platform from fraud, malware, spam, data breaches or other security risks.
26.5 We will not change the Agreement with retroactive effect, except where we are required by law or the change benefits you.
27.1 Internal complaints. You may complain to us, free of charge, about:
(a) any alleged failure by us to comply with the Agreement or with the law that applies to our services;
(b) technological issues that relate directly to the Platform and affect you; and
(c) any measure or behaviour by us that relates directly to the Platform and affects you, including any decision under clauses 8.9, 16, 17 or 18.
27.2 You can submit a complaint through the complaints form in the Seller Centre or by email to sellers@thekoshershop.com, within 6 months of the decision or event. We will acknowledge it within 2 Working Days, consider it properly, deal with it within a reasonable time proportionate to its importance and complexity (normally within 15 Working Days), and tell you the outcome in a clear and simple way. A decision about a complaint will be taken by a person who was not involved in the original decision where possible.
27.3 We publish, at least once a year, information on the number of complaints, the main types, the average time needed to process them and the outcome. We do this voluntarily.
27.4 Mediation. If a dispute is not resolved through our complaints system, either party may propose mediation. We are willing to engage in mediation with either of the following:
(a) CEDR (Centre for Effective Dispute Resolution), 100 St Paul’s Churchyard, London EC4M 8BU, United Kingdom (www.cedr.com); or
(b) a mediator entered in the register of mediators kept by the Ministry of Justice of the Czech Republic, chosen by agreement between us.
27.5 Mediation will be conducted in English, unless the parties agree otherwise. We will bear a reasonable proportion of the total costs of mediation, to be determined on the mediator’s suggestion, taking into account the merits of each party’s position, the conduct of the parties, and the size and financial strength of the parties.
27.6 Attempting mediation is voluntary and does not affect either party’s right to start court proceedings at any time, before, during or after mediation.
28.1 The Agreement and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it are governed by the law of the Czech Republic, excluding its conflict of laws rules and the United Nations Convention on Contracts for the International Sale of Goods.
28.2 The courts of the Czech Republic with jurisdiction for UDITA’s registered office have exclusive jurisdiction over any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Agreement. This applies equally to both parties. Each party may, however, apply to any competent court for urgent interim or protective measures.
28.3 UK sellers. For sellers established in the United Kingdom, nothing in clause 28.1 or 28.2 deprives you of rights that you have under Regulation (EU) 2019/1150 as it applies in the United Kingdom as assimilated law, the Online Intermediation Services for Business Users (Enforcement) Regulations 2020, or any other mandatory UK law, or of your right to bring proceedings in the courts of England and Wales where that UK law so provides.
28.4 Reason for this choice. We have chosen one governing law and one forum for all sellers so that the same rules apply to every shop, disputes are handled in the country where we are established and where the Platform is operated, and the Agreement is interpreted consistently. Judgments of Czech courts are enforceable in other EU member states under Regulation (EU) No 1215/2012, and in the United Kingdom under the Hague Convention of 2005 on Choice of Court Agreements and the Hague Judgments Convention of 2019.
28.5 Czech law clauses. To the extent permitted by law, including §1801 of the Czech Civil Code, the parties agree that §1799 and §1800 (adhesion contracts) of the Czech Civil Code do not apply to the Agreement. Each party accepts the risk of a change of circumstances under §1765(2), so that §1765 and §1766 do not apply. The Agreement is not concluded by means of usage under §558(2), and no business practice prevails over its express terms.
29.1 No exclusivity. The Agreement is not exclusive. You may sell your goods through other channels and we may allow other sellers to sell similar or identical goods.
29.2 Relationship. You and we are independent contractors. Except for the commercial agency in clause 12.1, nothing in the Agreement creates a partnership, joint venture, agency, franchise or employment relationship, and neither party may bind the other.
29.3 Assignment. You may not assign, transfer or subcontract any of your rights or obligations without our prior written consent, except that you may use couriers and ordinary service providers, for whom you remain responsible. We may assign or transfer the Agreement to an affiliate or to a buyer of all or part of our business on notice to you, provided that your rights under the Agreement are not reduced.
29.4 Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, provided that it notifies the other promptly and takes reasonable steps to limit the effects. This clause does not excuse your obligations to refund Customers or to pay amounts due.
29.5 Notices. Notices must be in writing and sent by email to the addresses in clause 9.4 or through the Seller Centre. An email notice is received on the Working Day after it is sent, unless the sender receives a notice of non-delivery.
29.6 Language. The Agreement is made in English. Any translation is for convenience only and the English version prevails.
29.7 Entire agreement. The Agreement is the entire agreement between us about its subject matter and replaces any earlier seller terms, including those published before the date of this version. Each party confirms that it has not relied on any statement, promise or forecast (including about sales, traffic or visibility) that is not set out in the Agreement. This does not limit liability for fraud.
29.8 Severability. If any provision is found to be invalid or unenforceable, it will be treated as modified to the minimum extent necessary to make it valid, or if that is not possible, as deleted, and the rest of the Agreement will continue in force.
29.9 Waiver. A failure or delay in exercising a right is not a waiver of it. A waiver must be in writing.
29.10 Third parties. Except as stated in clause 24.4, no person other than the parties has any right to enforce the Agreement.
29.11 Electronic records. The parties agree that records kept in the Seller Centre and our systems (including acceptance logs, messages and transaction records) are evidence of their content, unless proved otherwise.
1. Commission
1.1 For each item sold, a commission of 12.5% of the price paid by the Customer for the item, including VAT where VAT is included in the price, after any discount that you fund, and excluding delivery charges and any US sales tax.
1.1A Fee per order. In addition, a fixed fee of £1.25 (UK Site), €1.25 (EU Site) or $1.25 (US Site) for each order that a Customer places with your shop, whatever the number of items in it. Where one checkout includes products from several sellers, each seller’s part is a separate order.
1.2 Launch rate. For shops whose Shop Opening Date is on or before 31 December 2026, the commission is 6.2% instead of 12.5% for orders placed during the first 3 months after the Shop Opening Date. The fee per order under paragraph 1.1A and the payment processing fee still apply during that period. From the first day after that period, the standard commission applies without further notice.
2. Payment processing fee
2.1 For each order, the fee that our payment service provider (currently Stripe) actually charges for processing the Customer’s payment for your part of the order, including delivery charges, passed on to you at cost and without any mark-up. Where one payment covers orders from more than one seller, the fee is shared between the sellers in proportion to the amount of each seller’s order. The fee depends on the payment method and the country of the card, and is shown for each order in the Seller Centre.
2.2 Example (UK Site): an order of goods for £55 with £7 delivery, paid with a UK card. Commission: 12.5% of £55 = £6.88. Fee per order: £1.25. Payment processing fee: the amount Stripe charges on the £62 payment (for example, about £1.80). The rest is credited to you. During the launch period the commission is 6.2% of £55 = £3.41, and the fee per order and the payment processing fee are the same.
3. No other fees
3.1 Apart from the fees in paragraphs 1 and 2, there is no subscription fee, no shop opening fee, no listing fee and no withdrawal or transfer fee. The only optional fee is for paid promotion under paragraph 3A, which you pay only if you choose it.
3A. Paid promotion (optional)
3A.1 What you get. For each product you promote, for 14 days from the moment the payment is confirmed:
(a) the product appears among the first results on the shop page, on the category pages where it is listed and in search results that match it, ahead of products that are not promoted;
(b) the product appears among the first products on your own shop page;
(c) the product can appear in the “Promoted by our makers” section of the home page, which shows promoted products in random order; and
(d) the product is marked as featured for that period.
3A.2 What it does not include. Promotion improves visibility. It does not guarantee any number of views, clicks or sales, and it does not change the content rules, the approval of Listings or the reviews shown for the product.
3A.3 Price. £15 (UK Site), €17 (EU Site) or $19 (US Site) per product for each period of 14 days, plus VAT where clause 11.3 requires it. The price is shown in the Seller Centre before you pay. You pay by card at checkout; the fee is not deducted from your sales.
3A.4 Conditions. A product can be promoted only while it is approved, published and in stock, and while your shop is open. The number of products promoted at the same time on each Site is limited; when all places are taken, the option is not available until one becomes free. Where several promoted products appear in the same place, they are shown in an order that our system applies equally to all of them, which may rotate.
3A.5 Labelling. Promoted products are labelled “Sponsored” to Customers wherever they appear because of the promotion.
3A.6 Ending early. You may stop a promotion at any time, but the fee for the current period is not refunded. If we remove or hide the product because it breaches this Agreement or the law, the fee is not refunded. If we end the promotion for any other reason, or the product cannot be shown because of a fault of the Platform, we credit you the unused part of the fee in proportion to the days left, or offer you an equal period of promotion for the same or another product.
3A.7 Launch offer. Until 31 December 2026, each shop whose Shop Opening Date is in that period can receive one promotion of 14 days free of charge, for one product of its choice, on request to our team.
4. Refunds, cancellations and chargebacks
4.1 Commission, the fee per order and the payment processing fee are not refunded if an order is cancelled, refunded or charged back, in whole or in part, because our payment service provider does not return its fee, except where the cancellation or refund was caused by our own error or by a fault of the Platform, in which case we credit them to you. Chargeback fees charged in relation to your order are charged to you at cost.
5. Payouts
5.1 Clearance period: amounts for an order become available for payout 7 days after the order becomes a Completed Order.
5.2 With Stripe Connect (clause 12.1B): Stripe pays out your available balance to the bank account in your name registered with Stripe, on the payout schedule shown in the Seller Centre. There is no minimum payout and we charge no payout fee.
5.3 Without Stripe Connect (clause 12.4): bank transfer to an account in your name on request, normally within 5 Working Days. Minimum withdrawal £50 (UK Site), €50 (EU Site), $50 (US Site). No transfer fee.
5.4 For reference, shops on thekoshershop.co.il pay the same commission and payment processing fee under the separate Hebrew agreement.
This Annex explains the main parameters that determine the order in which Listings and shops appear on the Sites, and the reasons for their relative importance. It is published in line with Article 5 of Regulation (EU) 2019/1150 and the corresponding UK rules. We do not disclose details that would allow our ranking to be manipulated or that would deceive Customers.
1. Conditions for being shown at all
1.1 A Listing is shown only after we have approved it, while it is in stock or available to order, and while your shop is open. A Listing with a Kashrut Claim is shown only while a valid certificate is on our records; when the certificate expires the Listing is hidden. Listings subject to a measure under clauses 16 or 17 may be hidden or shown lower.
2. Search results
2.1 Search results are ordered by relevance: how closely the search words match the title of the Listing and, after that, its description, category and tags. This is the most important parameter, because Customers expect results that match what they are looking for.
3. Category pages, shop pages and the home page
3.1 By default, products on category pages and on the shop listing are shown in an order that we arrange. We mainly show newer Listings first, and we take into account whether a product is available and its relevance to the current season and forthcoming Jewish festivals (for example Pesach, Rosh Hashanah, Sukkot and Chanukah). Products and shops in featured sections of the home page and category pages are chosen by our team under paragraph 5.
3.2 Your own shop page shows your products in the order that our system applies to all shops, with newer Listings first, unless you or the Customer choose another order where the Platform allows it.
4. Customer choices
4.1 Customers can change the order of results by sorting by popularity (number of sales), average rating, newest, or price (low to high, or high to low), and can narrow results with filters such as category, price, kashrut authority or kosher status where available. A Customer’s choice overrides the default order.
4.2 Average ratings are a simple average of all published reviews, not weighted.
5. Editorial selections
5.1 Our team selects products and shops for featured collections, home page sections, gift guides, newsletters and social media, based on product quality, presentation, seasonal relevance, variety of sellers and categories, and the information we hold about Customer experience with a shop (for example on-time dispatch, cancellations, response times and reviews). We aim to give new sellers fair exposure. Editorial selection is not available for payment.
6. Payment and ranking
6.1 Sellers can pay to promote a specific product under paragraph 3A of Schedule 1. A promoted product is shown ahead of products that are not promoted on the shop page, on category pages, in matching search results and on the seller’s own shop page, and may appear in the “Promoted by our makers” section of the home page, for the 14 days paid for. Promotion is offered to every seller on the same published terms, and every promoted product is labelled “Sponsored” to Customers.
6.2 Paid promotion is the only way to pay for position. It does not affect the relevance order of products within the promoted group or outside it, editorial selections under paragraph 5, or reviews. Our commission does not affect ranking. If we change the way paid promotion works, we will update this Annex with at least 15 days’ notice.
7. Differentiated treatment
7.1 We do not sell our own goods on the Sites and do not give any seller preferential treatment through ranking, data access or fees, other than the launch rate in Schedule 1, which applies to every shop that meets its conditions, and paid promotion under paragraph 3A of Schedule 1, which every seller can buy on the same terms.
This Annex lists goods that you must never list on the Platform (prohibited) and goods you may list only if you meet the stated conditions and we have approved the category for your shop (restricted). It is not a complete list of what the law forbids, and you remain responsible for compliance with the law in every country to which you deliver. We may remove any Listing that we consider inappropriate for a curated kosher marketplace, with a statement of reasons.
Part A: Prohibited items
1. Any goods whose sale, possession or delivery is illegal in the country of dispatch or of delivery.
2. Food or drink without a valid kashrut certificate. Every food and drink Listing must carry a Kashrut Claim supported by a valid certificate under clause 6.
3. Food or drink presented with a Kashrut Claim that is false, not supported by a valid certificate, broader than the certificate, or based on an expired, suspended or withdrawn certificate; and any use of a kashrut authority’s name, symbol or logo without permission.
4. Counterfeit, replica or misrepresented Judaica, including:
(a) printed, photocopied or machine-produced mezuzah scrolls, tefillin parchments or Torah scrolls presented as handwritten or as fit for ritual use;
(b) handwritten scrolls presented as kosher (fit for ritual use) without the evidence in Part C;
(c) items falsely attributed to a named artist, scribe, workshop, manufacturer or place of origin, or falsely described as antique, as silver or other precious metal, or as made in a particular country; and
(d) tzitzit, tallitot or garments falsely described as shatnez free or as made to a particular ritual standard.
5. Counterfeit goods, and goods or content that infringe trade marks, copyright (including in prayer books and other texts), designs or other rights.
6. Goods that have been recalled, are subject to a sales ban, or are unsafe, including food past its use-by date.
7. Medicines, prescription products, medical devices, and supplements or other products with medicinal claims; products containing CBD or other substances not authorised as food or novel food in the country of delivery.
8. Tobacco, nicotine and vaping products, drugs and drug paraphernalia.

13. Services, digital content and downloads, tickets, and donations or charitable appeals (including paid prayers or blessings), unless we have introduced a category for them.
14. Products with health claims or claims of spiritual, protective or curative effect that are presented as factual (for example amulets claimed to cure illness).
15. Material that promotes hatred, violence or discrimination, including Nazi memorabilia and extremist symbols; sexually explicit material; and any material that is offensive to a reasonable observant Customer.
16. Goods from, or for the benefit of, persons or territories subject to sanctions.

20. US Site: alcoholic drinks of any kind, including kiddush wine and spirits.

Food and drink: a valid kashrut certificate under clause 6; registration as a food business; full compliance with clause 7.4; temperature-controlled delivery for chilled and frozen goods; delivery only to countries whose labelling and import rules you meet; product liability insurance under clause 22.
2. Products of animal origin sent across borders within or between the United Kingdom and the European Union: only with evidence of compliance with the import rules and official controls of the country of delivery, including health certificates, approved establishments and border control posts where they apply. US Site: only where the product may lawfully be imported into the United States and you meet the requirements of the FDA and, where relevant, the US Department of Agriculture.
3. Alcoholic drinks (including kiddush wine and spirits), UK Site and EU Site only: a valid licence for sale of alcohol (UK: premises licence covering off-sales and a designated premises supervisor); duty paid goods only; age verification at sale and on delivery (minimum age 18 or the higher age required in the country of delivery); minimum unit pricing where it applies; on the EU Site, sales only within your own member state unless you have shown us that you comply with the excise rules for distance sales in the member state of delivery; no delivery to countries where distance sales of alcohol are restricted by a state monopoly or otherwise.

9. Precious metal items: compliance with hallmarking law where applicable (in the UK, the Hallmarking Act 1973).
10. Antiques, second-hand Judaica, sacred books and scrolls: accurate description of age, condition and provenance; for ritual items, the evidence in Part C.
11. Plants, seeds and agricultural products (including arba minim, the four species for Sukkot): compliance with plant health import and phytosanitary rules in the country of delivery.
12. Personalised items: the Listing must state clearly that the right to cancel does not apply, and you remain responsible for the content you print or engrave.

1. For any claim that a mezuzah scroll, tefillin, sefer Torah, megillah or similar item is fit for ritual use, you must hold and provide on request:
