Website: thekoshershop.co.uk. Version 1.0.1. Last updated 29 October 2026. In force from 26 October 2026.
Details of the operator of the Site are on our Legal information page.
1.1 These terms apply when you use thekoshershop.co.uk (the “Site”) and when you buy products through it. Please read them before you place an order. By using the Site or placing an order you agree to them. If you do not accept them, please do not use the Site.
1.2 The Site is operated by UDITA s.r.o., a company registered in the Czech Republic (company ID (IČO) 19482841), whose registered office is at Růženy Svobodové 1818/28, 669 02 Znojmo, Czech Republic, entered in the Commercial Register kept by the Regional Court in Brno, file no. C 134801. In these terms “we”, “us” and “our” mean UDITA s.r.o.
1.3 You can contact us by email at info@thekoshershop.co.uk, through the contact page of the Site, or by post at the address above. We reply in English.
1.4 In these terms:
(a) “Seller” means the independent business that lists and sells a product on the Site;
(b) “Customer” or “you” means the person using the Site or buying through it;
(c) “Consumer” means an individual acting wholly or mainly for purposes outside their trade, business, craft or profession;
(d) “Business Buyer” means anyone buying for the purposes of their trade, business, craft or profession, including wholesale customers and anyone ordering on the basis of a quote;
(e) “Order” means a request to buy one or more products placed through the Site’s checkout;
(f) “Sale Contract” means the contract for the sale of a product between you and the Seller;
(g) “Content” means any text, image, review, question, message or other material that a user or Seller posts on or sends through the Site.
1.5 Nothing in these terms affects your statutory rights as a Consumer. Where a clause says it applies “as far as the law allows”, it is intended to have effect only to the extent it is lawful, and it is not intended to restrict any right you have that cannot be excluded or limited.
1.6 These terms are available in English only and the contract is concluded in English. You can save or print them from this page, and we send a copy with your order confirmation. We keep a record of your Order, which you can see in your account (if you have one) or obtain from us on request.
1.7 We do not subscribe to any code of conduct relevant to these terms.
1.8 Other documents that apply to your use of the Site are our Privacy and Cookies Policy, our Delivery page and our Returns and Cancellations page. If they conflict with these terms, these terms prevail. A Seller may publish its own delivery or returns information in its shop, but it cannot reduce your rights under these terms or under the law.
2.1 The Kosher Shop is an online marketplace. We provide the Site, the checkout, payment collection on behalf of Sellers and customer support. We do not own, make, store, pack or ship the products listed on the Site, and we are not the seller of them.
2.2 Each product is sold by the Seller named on the product page, in the Seller’s shop and at checkout. When you buy, the Sale Contract is made between you and that Seller. The Seller is responsible for the product, its description, its quality, safety and legality, delivery, returns and refunds, and for meeting your legal rights as a buyer, as set out in sections 9 to 12.
2.3 Every Seller on the Site is a business (a registered company, partnership or sole trader) and therefore a “trader” for the purposes of consumer law, which means that the consumer protections described in these terms apply to your purchase from that Seller. We do not allow private individuals to sell on the Site.
2.4 For each Seller we show in its shop or on the product page its legal name and any trading name, its geographic business address, its email address, the country from which it ships, and its company or business registration details. If that information is missing or appears wrong, please tell us.
2.5 We vet Sellers before their shop opens (including identity, address and business registration checks and, for food, kashrut certificates) and we review each new product before it is published. These checks are made to keep the marketplace trustworthy. They are not a guarantee of any Seller’s performance or of any product, and they do not make us a party to the Sale Contract.
2.6 One basket may contain products from several Sellers. In that case you are making a separate Sale Contract with each Seller. Delivery charges are calculated for each Seller separately, and each Seller ships its own products.
2.7 How products are ordered on the Site. Search results are ordered by how closely your search words match a product’s title, description, category and tags. Category pages and shop pages are shown by default in an order we arrange, mainly with newer products first and taking account of availability and seasonal relevance (for example, Jewish festivals), and some products are featured by our team. You can change the order and sort by popularity, average rating, newest or price. Products whose kashrut certificate has expired are not shown. No Seller can pay to rank higher. If we ever introduce paid placements, they will be clearly labelled “Sponsored”.
2.8 We do not sell products of our own on the Site, and we do not issue gift cards. Gift cards on the Site are offered by individual Sellers for their own shops (section 19).
3.1 When you pay at checkout, you pay us. We receive payment as the commercial agent of the Seller, acting only for the Seller, which has authorised us to conclude sales and receive payment on its behalf. Your payment to us discharges your obligation to pay the Seller for that Order, so the Seller cannot ask you to pay again.
3.2 Payments are processed by our payment provider, Stripe. Card and wallet details are handled by Stripe and are not stored by us or by the Seller. Your card issuer or wallet provider may have its own terms.
3.3 We keep a commission from each payment and pass the balance to the Seller. Our commission does not increase the price you pay: the price shown is the price you pay.
3.4 Refunds are made by us on the Seller’s behalf, to the payment method you used, unless you agree otherwise (see section 12).
3.5 Do not pay a Seller outside the Site, and do not agree to complete a purchase you started here by bank transfer or other means suggested by a Seller. Purchases made outside the Site are not covered by these terms, by our customer support or by our payment process, and we have no responsibility for them. Please report any Seller who suggests this.
4.1 You may browse the Site without an account. You need an account to see past orders, write reviews or use some features.
4.2 You must be at least 18 years old to place an Order or open an account. Some products (for example, wine and spirits, or knives) may only be sold to adults, and the Seller or its courier may ask for proof of age on delivery. If proof is not given, the Seller may refuse delivery and refund you, less the reasonable cost of the failed delivery where the law allows it.
4.3 You must give accurate information, keep your password private and tell us promptly if you think someone else has used your account. You are responsible for activity on your account unless it was caused by our failure to take reasonable care or by someone who obtained your details without any fault on your part.
4.4 Consumer accounts are for personal use. If you are buying for a business, please use the wholesale or quote routes described in section 21.
4.5 You may close your account at any time by contacting us. Closing your account does not cancel Orders already placed and does not affect your rights in respect of them.
4.6 You may not use the Site or place an Order if you are located in, or ordinarily resident in, a country or territory subject to comprehensive UK, EU, UN or US sanctions, or if you are named on, or owned or controlled by a person named on, a sanctions list. We may cancel Orders, refund payments and close accounts where we reasonably believe this applies.
5.1 You must use the Site lawfully, honestly and with respect for others. In particular, you must not:
(a) place an Order you do not intend to pay for, use a payment method you are not authorised to use, or use the Site for any fraud;
(b) make a chargeback or payment dispute that you know to be unfounded, or ask for a refund that you know you are not entitled to while keeping the product;
(c) make repeated returns or claims in a pattern that indicates abuse rather than genuine dissatisfaction (for example, returning used products as unused, or claiming non-delivery of parcels you received);
(d) buy products for resale through a Consumer account, or get around any quantity limit set by a Seller or by us;
(e) use robots, scrapers, crawlers or similar automated tools to access, copy, index or extract content, prices or data from the Site, or use the Site’s content to train or build any software, model or dataset, except standard search engine indexing allowed by our robots.txt file;
(f) interfere with the Site’s security or operation, introduce malware, overload it, or try to gain access to accounts, systems or data you are not entitled to;
(g) harass, threaten, insult or abuse any Seller, other customer or member of our staff, in messages, reviews or other correspondence;
(h) post or send Content that is unlawful, defamatory, hateful (including antisemitic content or content directed at any group because of a protected characteristic), sexually explicit, misleading or that infringes anyone’s rights;
(i) post fake reviews or misuse the review system in any way described in section 15;
(j) impersonate any person or business, or misrepresent your connection with them; or
(k) contact Sellers to arrange sales outside the Site (see clause 3.5).
5.2 You remain free to exercise your legal rights, including your right to cancel, to reject faulty goods and to raise a genuine dispute with your card issuer. Nothing in this section is intended to prevent or discourage that. We ask only that you contact us first, because we can often resolve problems faster than a card dispute can.
5.3 Where we reasonably suspect fraud or abuse, we may share relevant information with the Seller, with our payment provider, with fraud prevention services and, where appropriate, with the police, in line with our Privacy and Cookies Policy.
6.1 We may suspend or close your account, cancel an Order that has not yet been dispatched, remove your Content or restrict your use of features such as reviews or messaging, if we reasonably believe that:
(a) you have seriously or repeatedly broken these terms;
(b) your use of the Site involves fraud, abuse or a risk to other users, Sellers or us; or
(c) we are required to do so by law or by a regulator, court or payment provider.
6.2 We act proportionately. Unless it would be unlawful, compromise an investigation or create a risk to others, we will tell you what we are doing and why, and give you a chance to respond. You may ask us to review the decision under clause 16.5.
6.3 If we cancel an Order under this section before it is dispatched, you will receive a full refund. Suspension of your account does not remove any right you have in respect of Orders already completed.
6.4 We may stop operating the Site, or any part of it, on reasonable notice. Existing Orders will still be completed or refunded.
7.1 Prices are set by each Seller and are shown in pounds sterling (GBP). Prices include VAT where VAT is payable.
7.2 Before you commit to buy, the product page shows the price and either the delivery charge or how it will be calculated, and the checkout shows the total amount you will pay, including all mandatory charges, broken down by Seller. We do not add hidden or mandatory fees at a later stage. Optional extras are never pre-selected.
7.3 The product page states the country from which a product is dispatched. Where a product is sent to you from outside the United Kingdom, the Seller must deliver it with all import VAT, customs duty and courier handling charges already paid, so that the total shown at checkout is the final price, unless the product page and the checkout clearly tell you otherwise before you buy, with an explanation of the charges that may be payable on delivery.
7.4 For some Orders the law treats us as responsible for charging and accounting for UK VAT (for example, goods worth £135 or less imported into the United Kingdom, or goods in the United Kingdom sold by a Seller established elsewhere). Where this applies, we account for the VAT as the law requires. This does not make us the seller of the product for any other purpose, and the Seller remains responsible to you under the Sale Contract.
7.5 If a product is listed at a price that is obviously and unmistakably wrong (for example, a clear typing error), the Seller may decline the Order before accepting it. If the Order has already been accepted, the Seller may cancel it only where the error was so obvious that you could reasonably have recognised it as a mistake. In either case you will receive a full refund.
7.6 Discount codes and promotions are subject to the conditions stated with them, can be withdrawn at any time for future Orders, and have no cash value. Any price comparison (such as a “was” price) must reflect a genuine previous price. Please report any you believe is not genuine.
8.1 To buy, you add products to your basket, go to checkout, enter delivery and payment details, review the summary (where you can correct any mistakes by going back or editing the basket) and then click the button marked “Place order” or similar wording that makes clear you are committing to pay.
8.2 Your Order is an offer to buy the products from the relevant Seller or Sellers. Payment is taken or authorised when you place the Order.
8.3 We email you without undue delay to acknowledge that we have received your Order. That acknowledgement is not the Seller’s acceptance.
8.4 A Sale Contract is formed with each Seller when that Seller accepts your Order, which happens when we send you a confirmation of acceptance or dispatch on the Seller’s behalf, or when the Seller dispatches the products, whichever is earlier.
8.5 A Seller may decline an Order, for example because a product is out of stock, cannot be delivered to your address, the price was wrongly stated (clause 7.5) or there is a reasonable suspicion of fraud. If so, we will tell you and refund the amount paid for the declined products in full and promptly, and in any event within 14 days.
8.6 Sellers must accept or decline Orders within 2 working days. If a Seller has not done so, we may cancel that part of the Order and refund you in full.
8.7 Once the Sale Contract is made, the Seller’s key information is sent to you on a durable medium (we send it by email on the Seller’s behalf), including the Seller’s identity and address, the total price, delivery arrangements, your right to cancel and the model cancellation form.
9.1 The Seller is responsible for delivering the products. The product page shows the Seller’s estimated delivery time and charges. If no time is agreed, the Seller must deliver without undue delay and in any event within 30 days after the Sale Contract is made.
9.2 If the Seller does not deliver within the agreed time, or within 30 days where no time was agreed, you have the rights given by the Consumer Rights Act 2015, which may include the right to treat the Sale Contract as at an end and receive a full refund.
9.3 Responsibility for the products passes to you when they come into your physical possession or that of a person you have nominated, but not a courier chosen by the Seller.
9.4 Please check deliveries promptly. If a parcel does not arrive, arrives damaged or is incomplete, please tell the Seller (through your account or the order email) or us within 14 days of delivery, or of the expected delivery date, so that we can investigate while the courier’s records are available. For fresh or chilled food, please tell us within 48 hours. This request helps us resolve problems quickly. It does not shorten or limit your legal rights, which you may still rely on after that period.
9.5 Some products, especially chilled or fresh food, need someone available to receive them. The product page will explain any special delivery arrangements. If delivery fails because of incorrect details you gave or because no one was available at an agreed time, the Seller may charge reasonable redelivery costs, which will be stated in advance.
10.1 If you are a Consumer, you have the right to cancel a Sale Contract within 14 days without giving any reason. The cancellation period ends 14 days after the day on which you (or someone you nominate, other than the courier) receive the products. If an Order from one Seller arrives in several parcels, the period runs from the day you receive the last one.
10.2 To cancel, tell the Seller or us clearly before the period ends. The easiest way is the “Withdraw from contract here” page of the Site, where you fill in your name, order number and the products concerned and press “Confirm withdrawal”; we then send you an acknowledgement by email with the date and time of your notice. You may also use the model cancellation form sent with your order confirmation, or any clear statement by email to the Seller or to info@thekoshershop.co.uk. You do not need to give a reason.
10.3 You must send the products back to the Seller (at the return address the Seller gives you) without undue delay and in any event within 14 days after the day you tell us you are cancelling. You pay the direct cost of returning them only if the product page or the Seller’s returns information told you so before you bought; otherwise the Seller pays.
10.4 The Seller will refund the price of the products and the standard delivery charge you paid (but not any extra you paid for a faster or premium delivery option you chose) within 14 days after receiving the products back, or after you provide evidence that you have sent them back, whichever is earlier. If you cancel only some products from an Order, the delivery charge is refunded only where the cancellation leaves no products from that Seller.
10.5 You may handle the products as you would in a shop to establish their nature, characteristics and working. The Seller may reduce your refund to reflect any loss in value caused by handling beyond that.
10.6 The right to cancel does not apply to:
(a) products that are liable to deteriorate or expire rapidly, such as fresh, chilled or frozen food, baked goods and flowers;
(b) products made to your specifications or clearly personalised (for example, engraved Judaica or a personalised cake);
(c) sealed products that are not suitable for return for health protection or hygiene reasons, once you have unsealed them after delivery;
(d) sealed audio or video recordings or sealed computer software, once you have unsealed them after delivery;
(e) products which, by their nature, have become inseparably mixed with other items after delivery.
10.7 The product page tells you if one of these exceptions applies. A kashrut seal is not by itself a health protection or hygiene seal, so opening it does not on its own end your right to cancel unless another exception applies.
10.8 The right to cancel does not apply to Business Buyers.
11.1 If you are a Consumer, the Seller must supply products that are of satisfactory quality, fit for any particular purpose you made known to the Seller, and as described (including any description of the product as kosher, its certification, ingredients, allergens or origin). These rights come from the Consumer Rights Act 2015 and cannot be excluded.
11.2 In summary, and without limiting your rights: if a product does not meet these standards, you may reject it and get a full refund within 30 days of delivery (or a shorter period for perishable products, reflecting how long they can reasonably be expected to last); after that, or if you prefer, you may ask for a repair or replacement; and if that is not possible or does not succeed, you may be entitled to a price reduction or a refund. A fault that appears within six months of delivery is presumed to have existed at delivery unless the Seller proves otherwise. You may have rights for up to six years (five years in Scotland) after delivery. For more detail, see the Citizens Advice consumer service.
11.3 The Seller pays the reasonable cost of returning faulty or misdescribed products.
11.4 Sellers of food must give the mandatory food information, including allergens, on the product page before you buy and with the product on delivery. If you have an allergy or intolerance, please read that information and the product label, and contact the Seller if anything is unclear. We do not check or guarantee food information supplied by Sellers.
12.1 Refunds are made on the Seller’s behalf, by us, to the payment method you used, without any fee to you, within the time limits set by law.
12.2 If you have a problem with an Order, please first contact the Seller through your account or the link in your order email. Sellers must reply within 2 working days.
12.3 If the Seller does not reply within 3 working days, or you cannot reach agreement, contact us. Acting on the Seller’s behalf under the authority the Seller has given us, we will look at the information from you and from the Seller and may agree with you a refund, replacement or other remedy, paid from money we hold for the Seller. This does not prevent you from relying on your legal rights against the Seller or from going to court or to an alternative dispute resolution provider.
12.4 Helping in this way is a service we choose to offer. It does not make us the seller of the product or a guarantor of the Seller’s obligations, except where we have expressly agreed otherwise or the law makes us responsible.
13.1 Every food and drink product on the Site must be supported by a valid certificate from a recognised kashrut authority, uploaded by the Seller. Before such a product is listed, we check that a certificate has been uploaded, that it appears to relate to the Seller or the product, and that it is in date. If the certificate on our records expires, we hide the affected products until a valid certificate is provided.
13.2 We are not a kashrut authority. We do not supervise Sellers’ premises, ingredients or production, and we do not decide whether any product, ingredient or certification is acceptable under Jewish law. Responsibility for the kosher status of a product, and for the accuracy of the certificate, rests with the Seller and with the certifying authority named on it.
13.3 Standards and certifications vary, and communities and individuals accept different authorities and practices (for example, on chalav Yisrael, pas Yisrael, Pesach or mehadrin standards). If you have a specific requirement, please check the certificate shown on the product page and the label, ask the Seller, or consult your rabbi before buying. Where a product is marked with a specific status (such as “Kosher for Pesach” or “Parev”), that status is part of the product’s description and the Seller is responsible for it under clause 11.1.
13.4 If you believe a kosher claim is wrong or a certificate is invalid, please tell us at info@thekoshershop.co.uk. We will investigate, may contact the certifying authority, and may hide products while we do so.
13.5 Content on the Site about kashrut (including our blog) is general information only and is not a halachic ruling.
14.1 Product descriptions, images, prices, delivery terms, certificates and other listing content are provided by Sellers. We review new products before publication, but we cannot check every statement, and the Seller is responsible for the accuracy and lawfulness of its listings.
14.2 Pictures are for illustration. Small differences in colour or appearance caused by photography or screens are not a defect, but a product must still match its description.
14.3 We may edit the presentation of listings (for example, for format, translation or category) without changing their meaning, and may remove listings that breach the law or our policies.
15.1 You may review a Seller or product only if you have bought from that Seller through the Site. Reviews must reflect your own genuine experience.
15.2 You must not, and must not ask or pay anyone else to:
(a) write a review that is not based on a genuine experience, or that misrepresents who wrote it;
(b) write a review in return for money, a discount, a free product or any other incentive, unless that incentive is clearly disclosed in the review and was offered regardless of whether the review is positive or negative;
(c) review your own shop or products, those of a business connected to you, or those of a competitor; or
(d) arrange to exchange reviews with others, or post several reviews of the same experience.
15.3 Sellers may not offer incentives for positive reviews, may not ask customers to remove or change negative reviews in exchange for a refund or other benefit, and may not pressure customers in any way about reviews.
15.4 How we handle reviews:
(a) We publish positive and negative reviews alike. We do not suppress or delay reviews because they are negative, and Sellers cannot choose which reviews are published.
(b) Only customers with a completed purchase from the relevant Seller can submit a review. We use automated and manual checks to detect suspicious patterns, and we act on reports.
(c) We may remove or decline to publish a review that breaches this section or section 5, contains personal data of others, is unrelated to the product or Seller, or that we reasonably believe is unlawful. If we remove your review, we will tell you why unless the law prevents us.
(d) Ratings are the simple average of all published reviews for that Seller or product. They are not weighted.
(e) Where a review was incentivised, it is labelled as such.
15.5 If you believe a review is fake or misleading, use the report link or email us. We will review it and tell you the outcome. We follow the Digital Markets, Competition and Consumers Act 2024 and the Competition and Markets Authority’s guidance on fake reviews.
16.1 How we protect users. Every Seller is vetted and every new listing is reviewed by a person before it is published. Reviews can only be written by verified buyers. We may use automated tools to detect fraud, spam and suspicious patterns, but decisions to remove Content or suspend accounts are taken or checked by a person. Messages through the Site are monitored for fraud, payment diversion and abusive content. We remove illegal content as soon as we become aware of it, and we suspend or close the accounts of those who post it (clause 16.6). These measures are part of how we meet our duties under the Online Safety Act 2023.
16.2 If you see Content on the Site (including a listing, a review or a message) that you believe is illegal, unsafe, infringes your rights or breaches these terms, please use the report link or email info@thekoshershop.co.uk with the location of the Content (for example, the web address), the reason, and your name and email address.
16.3 We acknowledge reports without undue delay, review them promptly and diligently, act where needed (which may include removing Content or suspending a Seller or user), and tell you the outcome.
16.4 If we remove or restrict your Content or account, we tell you what we did, why, and how to complain, unless the law prevents us or doing so would create a risk to others.
16.5 Complaints. You may complain to us about: Content you believe is illegal; a decision to remove or restrict your Content or to suspend or close your account; or our failure to follow these terms on safety. Email info@thekoshershop.co.uk with “Complaint” in the subject, within 6 months of the decision. A member of our team who was not involved in the original decision reviews it where possible. We aim to give you a reasoned answer within 14 days. If we find we were wrong, we reverse the decision without undue delay.
16.6 Repeat misuse. We may suspend, after a warning, the accounts of users who frequently post manifestly illegal Content, and we may stop dealing for a reasonable period with reports or complaints from anyone who frequently submits manifestly unfounded ones.
16.7 If a product you have bought is unsafe, stop using it and contact us and the Seller. We may notify the relevant authorities and may contact other buyers of the same product.
17.1 The Site, its design, software, text, logos, the name “The Kosher Shop” and the content we create (including blog articles) belong to us or our licensors. You may view and print pages for your personal, non-commercial use. You must not otherwise copy, reproduce, republish or exploit them without our written permission.
17.2 Listing content belongs to the relevant Seller or its licensors and is licensed to us.
17.3 When you post a review, photo, question or other Content on the Site, you keep ownership of it, but you grant us and the relevant Seller a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, adapt (for example, by resizing or formatting, without changing its meaning) and translate it in connection with the Site and its promotion, for as long as it is displayed and for a reasonable period after. You confirm that you have the right to grant this licence and that your Content does not infringe anyone’s rights.
17.4 If you believe content on the Site infringes your intellectual property, please report it under section 16.
18.1 The Site includes a directory of kosher and Jewish community businesses. Listings may be created by us from publicly available information or by the businesses themselves, and are free of charge. Unless a listing states otherwise, the listed business is not a Seller on the Site and any dealings you have with it are entirely between you and that business.
18.2 A directory listing is for information only. It is not an endorsement or recommendation, and it does not mean we have checked the business, its kashrut status, its licences or the quality of its goods or services. Information may be out of date. Please check directly with the business and, where relevant, with its certifying authority.
18.3 A business may claim its listing, ask us to correct it or ask us to remove it by contacting us. We deal with removal requests within 2 working days.
18.4 Our blog and other editorial content are general information only. They are not professional, legal, medical, nutritional or halachic advice. Mention of a business, product or Seller in editorial content is not an endorsement unless it says so, and any paid or sponsored content will be clearly labelled as advertising.
18.5 The Site may link to other websites. We are not responsible for their content, availability or practices.
19.1 We do not issue gift cards of our own. A Seller may offer a gift card for its own shop. That gift card is issued and sold by the Seller, can be used only to buy that Seller’s products on this Site, and cannot be used with other Sellers or on our other websites.
19.2 The Seller sets the gift card’s terms, which are shown on the product page before you buy, including its value, how to use it and how long it is valid. A Seller’s gift card must be valid for at least 12 months from the date of purchase, or longer where the law requires.
19.3 A gift card can be used in full or in part, and any unused balance stays available until it expires. It cannot be exchanged for cash except where the law requires. If you cancel a purchase that was paid with a gift card, the refund is returned to the gift card.
19.4 If you are a Consumer, you may cancel the purchase of a gift card within 14 days of buying it, provided it has not been used, and receive a full refund.
19.5 The Seller is responsible to you for honouring its gift card. If a Seller closes its shop while your gift card still has a balance, the Seller must refund the unused balance to you, and we will help you reach it. Where we still hold money for that Seller, we may use it to make that refund on the Seller’s behalf. Apart from this, and from our own obligations under these terms, we are not responsible for a Seller’s gift card.
19.6 Please keep your gift card code safe and treat it like cash. Neither we nor the Seller are responsible for a lost or stolen code, or for its use by someone who has it, unless this was caused by us or by the Seller. A gift card obtained by fraud may be cancelled.
20.1 Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, and for breach of your statutory rights as a Consumer, including those under the Consumer Rights Act 2015.
20.2 We are responsible for providing the Site and our own services with reasonable care and skill. Subject to clause 20.1, we are not responsible for the performance of a Sale Contract by a Seller, or for a Seller’s products, listings or conduct, except where the law makes us responsible, where we have caused the loss ourselves, or where we have expressly agreed otherwise.
20.3 Subject to clause 20.1, if we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. Loss is foreseeable if it was obvious that it would happen or if, at the time you placed the Order, both we and you knew it might happen. We are not responsible for loss that is not foreseeable.
20.4 The Site is for domestic and private use by Consumers. Subject to clause 20.1, if you use a Consumer account for business purposes, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.
20.5 We aim to keep the Site available and free from errors and viruses, but we do not promise that it will be uninterrupted or error-free. We may suspend access for maintenance, security or legal reasons. Subject to clause 20.1, we are not liable for temporary unavailability of the Site.
20.6 Subject to clause 20.1, our total liability to you for all claims arising from our own marketplace services in connection with any one Order is limited to the greater of the total amount you paid for that Order and £150. This limit never applies to a refund you are owed.
21.1 This section applies if you buy as a Business Buyer, including through wholesale prices or the “Request a Quote” feature. Where it conflicts with other sections, this section prevails for Business Buyers.
21.2 Business Buyers are not Consumers. The consumer protections described in sections 9 to 12 (including the right to cancel and the Consumer Rights Act 2015 remedies) do not apply. Your rights against the Seller are governed by the Sale Contract, any terms the Seller states for wholesale or quoted orders, and the law applicable to business contracts.
21.3 A quote is given by the Seller, not by us, and is valid for 14 days unless it states otherwise. A quote is an invitation to order. The Sale Contract is formed only when you accept the quote through the Site and the Seller confirms. Wholesale orders may be subject to minimum quantities and delivery terms set by the Seller.
21.4 You confirm that you are entitled to buy on behalf of the business named in your account and that any business information you give (including your VAT number) is accurate.
21.5 Business Buyers must raise any claim about an Order with the Seller within 14 days of delivery, or of the date delivery was due, failing which the Order is treated as accepted, unless the Seller’s own terms say otherwise or the defect could not reasonably have been discovered in that time.
21.6 As far as the law allows, and subject to clause 20.1 (which applies to Business Buyers in the same way, except for the reference to Consumer statutory rights):
(a) we exclude all conditions, warranties and other terms implied by statute or common law in relation to our services;
(b) we are not liable for any loss of profit, revenue, business, goodwill or anticipated savings, or for any indirect or consequential loss; and
(c) our total liability to a Business Buyer for all claims in any period of 12 months arising from our marketplace services is limited to the greater of the commission we received on that Business Buyer’s Orders in the 12 months before the claim arose and £1,000.
21.7 A Business Buyer will indemnify us against any loss, liability, fine or reasonable cost (including legal fees) we suffer as a result of a claim by a third party arising from the Business Buyer’s breach of these terms or misuse of the Site.
If you are a Consumer and you deliberately misuse the Site or break these terms, and as a direct result a third party makes a claim against us, you are responsible for the reasonable losses and costs we suffer as a result. This does not apply where we caused or contributed to the loss.
23.1 Neither we nor a Seller will be responsible for delay or failure caused by an event outside reasonable control, such as natural disaster, epidemic, war, terrorism, civil unrest, strike by a third party’s workforce, failure of a public network, payment system or carrier, or government action. The affected party will tell you as soon as possible and take reasonable steps to limit the delay.
23.2 If such an event significantly delays delivery, you may cancel the affected Order and receive a full refund for products you have not received. This clause does not affect your rights in respect of faulty or misdescribed products.
24.1 If you are unhappy with an Order, follow clause 12. If you are unhappy with us or the Site, email info@thekoshershop.co.uk with your name, order number (if any) and a short description. We acknowledge complaints within 3 working days and aim to give you a full reply within 14 days.
24.2 If we cannot resolve your complaint, we will tell you in writing the name and website of a certified alternative dispute resolution (ADR) provider that could deal with it, and whether we agree to use that provider. We are not obliged to use ADR.
24.3 You can also get free advice from Citizens Advice (England and Wales), Advice Direct Scotland or Consumerline (Northern Ireland), and you may bring a claim in court. Small claims can be made online in England and Wales through the HM Courts and Tribunals Service money claim service.
25.1 These terms, and any Sale Contract made through the Site with a Consumer, are governed by the law of England and Wales.
25.2 If you are a Consumer, you may bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts and you keep the protection of the mandatory consumer law of the place where you live. This choice of law does not deprive you of any protection given to you by the law of the country in which you are habitually resident that cannot be excluded by agreement.
25.3 If you are a Business Buyer, these terms and any dispute or claim arising from them (including non-contractual disputes) are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
26.1 We may change these terms from time to time, for example to reflect changes in the law, in our services or in how the marketplace works. The version in force when you place an Order applies to that Order.
26.2 If you have an account, we will email you at least 14 days before a significant change takes effect. If you do not agree to the change, you may close your account before it takes effect. Changes required urgently by law or for security reasons may take effect sooner, and we will tell you as soon as practicable.
26.3 We may change or withdraw features of the Site, provided that this does not affect Orders already placed.
27.1 If any part of these terms is found to be invalid or unenforceable, the rest continues to apply.
27.2 If we do not enforce a right immediately, we may still enforce it later.
27.3 We may transfer our rights and obligations under these terms to another organisation that takes over the operation of the Site. We will tell you if this happens and ensure that the transfer does not reduce your rights. You may not transfer your rights without our consent.
27.4 These terms are between you and us. No other person has any right to enforce them, except that a Seller may rely on the provisions that refer to the Seller.
27.5 We send notices to you by email to the address in your account or Order. You can send notices to us at info@thekoshershop.co.uk.
27.6 Our Privacy and Cookies Policy explains how we use personal data. We share the information needed to fulfil your Order (name, delivery address, contact details and Order details) with the Seller, who must use it only for that purpose and in line with data protection law.
